A public hearing has been set for June 13, at610p m at the City Office Mayor Eldon McColley defined a home occupation as Any income -producing work done m the home Some of the home projects mentioned at the City Council Meeting were doing income tax, selling cleaning products, having a beauty or barber shop, selling worms, baby sitting in the home, sewing, writing, making jewelry, giving piano lessons or a doctor treating an emergency at his home. If no public opposition is met, this ordinance could become law next week. Mayor McColley explained the ordinance would allow income-producin- g work to be done in a home, as a secondary income, as long as it was not obnoxious to the neighbors, was done entirely within the home and not in the garage, yard or any other buildings, caused no alterations to the home and used no more than 25 percent of the home, or 300 square feet Absolutely no signs or extra parking would be allowed. May council members expressed concern over the enforcibility of such an ordinance. Councilman Leland 1 Erickson said, dont think we should pass anything we cant enforce. Councilman Eldon Orton stongly suggested that anyone who par- - ticipates in any kind of home occupation should be required to obtain It was suggested an initial fee of $10 might be appropriate Councilman Erickson asked, How do you control them, even if you do require permits Councilman Dr. Alan Christiansen indicated he was sharply opposed to the all encompassing" ordinance, calling the problem a keg of worm-- s He said he thought the council needed to define the problem areas and pass a more specific ordinance. I think we need to outlaw certain things, or why go to the trouble of writing it up The Mayor replied, If we start eliminating certain things, it is discriminatory and therefore unconstitutional. Dr Christiansen asserted, We can throw out all the zoning ordinances. He said there had to be some definable differences in different home occupations that would make some objectionable and some not Councilman Erickson said that his w ife use to give piano lessons. I dont think anyone in the neighborhood knew about it, except me Conditional use ordinance passed After receiving a report mae by NASA of the North Ogden bench areas, detailing the sensitive areas, the city council passed a conditional use ordinance. This ordinance would make it necessary for anyone desiring to develop a zoned sensitive area to receive a special permit to do so which would hinge upon their complying with whatever is necessary to protect the area. |
