THOMPSON Publisher Office Manager M. 1 L : SUPREME COURT (Continued from Page 1) Mr. Justice Holmes what seemed to them to he first principles are believed by half their fellow men to be wrong. Judicial Dictatorship Stop So there do not seem to be any vepy good reasons against a system that will compel, or at least encourage, judges to retire at 70. An exceptional man may render distinguished service in his ripe age, but when we come to examine the supreme court of the United States, instead of finding one or two eider judges as an exception, we find that the exception has become the rule itself. Judicial Dictatorship Stop There is not a judge on our supreme court of the United States under CO. Six of them are over 70, and five of them are at or over 75. With all respects due the dignity of advanced years, no one can sincerely defend having a majority of the nations high court approaching 80 years of age. Yet, when the President brings this situation to the attention of congress and proposes a method of dealing wiih it, he is denounced by his political enemies from one end of the country to the other. Judicial Dictatorship Stop Since the civilized world accepts the principle of a retirement system, the fact that a retirement system will affect a majority of the supreme court is not a reason against it. On the contrary, it is an extremely strong argument in favor of it. It is sound to retire judges at a certain age limit, then the fact that two-thirof the court are past such an age limit is all the more reason to adopt the proposal promptly. Judicial Dictatorship Stop When Mr. Roosevelt became President he was not responsible for the situation as he found it. But as President of the United States and the leader of American democracy he is responsible if he does not deal with the situation which blocks the sound and legitimate progress of the American people. Judicial Stop Dictatorship The opposition to President Roosevelts proposal comes mainly from those who are bitterly opposed to, and from, a few who fail to keep their eyes fixed on, the essence of democratic government. It is desirable, practicable, and constitutional. The supreme court needs justices who are cognizant of the fact that industrial and economic problems have changed since the oxcart days. The method of changing the courts viewpoint can be applied quickly and without all of the long drawn out agony of en- acting constitutional amendments. It is strictly constitutional congress has unquestioned power to enlarge or diminish the size of the court at will.
