to authorize the people of the territory of kansas to form a constitution and stae stam stai slap sl ap 6 gov government overn ern ment preparatory to their admission into the union when they have the requisite population be it enacted by the senate and house of ri of the united states of ameri ia a in congress Con gregs assembled that for the pur pir fise rise r ise of making an enumeration of the inh ki tants authorized to vote under the provisions of this act an apportionment and an election of members ofa ota of a convention to form a state constitution for kansas as hereinafter provided div hive five e competent persons shall be appointed by the president by and alid with the advice and consent of the senate to be commissi commissioners onerA a majority a bority of whom shall constitute a quorum for the purpose of carr carrying Ting into effect the provisions of this act each of whom before entering upon the duties of his office shall take and subscribe an oath or affirmation that lie he will support the constitution of the united states and faithfully and impartially exercise and discharge the duties enjoined on him by this act according to the best of his skill and judgment which oath or affirmation shall be administered to them severally and be duly certified by a ludge judge clerk or commissioner of a court of the united states and filed and recorded in the office of the secretary of the territory of kansas sec 2 and be it further enic enacted ted that it shall be the duty of said commissioners tinder under such regulations as the Secie secretary tary of the interior may prescribe to cause to be made a full and faithful enumeration of the legal voters resident in each county in the said territory on the fourth day of july eighteen hundred and fifty six and make returns thereof during the month of August next or as soon thereafter r as practicable one of which returns shall be made to the office of the secretary of the interior and one to the secretary of the thie territory to ry of kansas and which shall also exhibit the names of alt such legal voters classed in such manner as shall be prescribed by the re regulations of the secretary of the interior sec ec 3 and be it further enacted that it shall be the duty of the secretary of the interior immediately after the passage of this act to prescribe re regulations and forms to be observer observed ver yer in making le the enumeration aforesaid and to furnish uhe the same with all necessary essaV printed blanks to each of the commissioners as soon as may be after their appointment and the commissioners shall meet without delay at the seat of government of kansas territory and proceed to the discharge of the duties herein imposed upon them theland the mand ana appoint a secretary to the board and sich such other persons as shall be necessary to aid and assist them in taking the enumeration herein provided for who must roust also b be e duly sworn faithfully h impartially i apar and truly to discharge the duties assigned them by the commissioners sec see 4 and be it further enacted that said board of commissioners shall so soon as said census shall be completed and returns made proceed proceed to make an apportionment of the members aers for a convention coen tion among the different dif dlf counties in said territory in the following manner the whole number of letai leeal voters shall be divided by fifty two and the product of such division rejecting an any fraction of a unit shall be the ratio or ru ame e of apportionment of members among amon amod the several counties and if a any y county shan shau not have a number of ol legal v voters t ers thus ascertained equal to the ratio it shall shaft be attached to some adjoining county and thus form a representative district the number nii nit ibber of said voters in each county or district shall then in tro divided by the ratio and the product shall be the number of re representatives apportioned to such county or district provided that the loss in the number of members caused causer by the fractions remaining in the several counties in the division of the legal voters thereof shall be compensated by assigning to so many counties as have the largest fractions an additional member for its fraction as may be necessary to make the whole number of representatives fifty two sec 5 and be it further enacted that the said board immediately after the apportionment of the members of said convention shall cause a sufficient number of copies thereof and of the returns of the census specifying the name of each le leai legal leal al voter in each county or district to be published and distributed among among we inhabitants of the several counties an and shall transmit one copy of the said apportionment and census duly authenticated by them to each clerk of a court of record within with in the territory who shall file the same and keep 0 open en to the inspection of every inhabitant who sall sali shall desire to examine it and shall also cause other copies to be posted tip up in at least three of the most public places jr in each voting pre 1 to the eni end that eve every inhabitant may inspect the same ani ane and 1 aa aply Z IV to the board to correct any error he may find therein in the manner hereinafter provided sec 6 and be it further enacted that said board shall remain in session each day sundays excepted from the time of making said apportionment until the tho day of october next at such places as shall be most convenient to the inhabitants of said territory and shall proceed to the inspection of said returns and bear ilear correct and finally determine according to the facts without unreasonable delay under proper regulations to be made by the board fo for 1 the ascertainment of disputed facts concerning said enumeration all questions concerning the omission of any person from said returns or the improper insertion of any name on said returns and any other question affecting the integrity or hide fide fidelity lity fity of said returns and for this purpose the said board and each member thereof shall have power to adm administer nister hister oath oaths and examine witnesses and compel their attendance in such manner as said board shall deem them necessary sec 7 and be it further enacted that as I 1 soon as s the said lists of legal voters shall thus have been revised and corrected it shall be the duty of said board to cause cop copies coples es thereof to be printed and distributed generally among the inhabitants of the proposed state and one 0 r 1 e copy kopy copy shall be deposited with the clerk of aae each h court of record within the limits of the proposed state and one copy delivered to each judge of or the election and at least three copies shall be posted up tip at each place of voting sec 8 and be it further enacted that an election shall be held for members of a con to form a constitution for the state of kd kansas ansas lic according cording to the apportionment to be bee made aforesaid on the them first tuesday after the first monday in november nove m ber eighteen hundred hun dred and fifel fifty six to be held at such places and to be con conducted I 1 acted in such manner both as to persons who shall hall superintend such election and the returns thereof as the board of commissioners shall appoint and direct except in cases by this act otherie otherwise lse ise provi provided eded and at such election no person shall be permitted to vote un unless I 1 ess his name shall appear on said corrected lists sec 0 and be it further enacted that the board of commissioners shall have power and it shall be their duty to make all needful rules and regulations for the conduct of the said election and the returns thereof they shall appoint three suitable persons to be judges judges of the election at each place of voting andere and pre scribe the mode of supplying supplying vacancies they shall cause copies of t the e rules and regulations with a notice of the place places 3 of ho holding 1 d ing elect elections lons ions and the names of the judges to be published and distributed in every election district or precinct ten days before the ahe day of election and shall transmit a copy thereof to the clerk of each court of record and one copy to each judge D of election sec see 10 and be it further enacted that the judges of election shall each before entering on the discharge of his duties make oath or affirmation that he will faithfully and lm impartially ar discharge the duties of judge of the elec election according to law lav which oath may be administered by any officer authorized by law to administer oaths the clerks of of election shall be appointed by the judges and shall take the like oath of affirmation to be administered by one of the judges or by any of the officers aforesaid duplicate returns of election shall be made and certified by the judges and clerks one of which shall be deposited in the office of the clerk of the tribunal transacting county business for the county in which the election is held and the other shall be transmitted to the board of commissioners whose duty it shall be to decide under roper proper regulations t to be made by themselves wro who are en entitled titled to certificates of election and to issue such certificates accordingly to the persons who upon examination of the returns and of such proofs as shall be adduced in case of a contest shall appear to have been belen duly elected in each county or district provided in case of a tie or oe of a conte st in which it cannot annot be satisfactorily determined who was duly elected said commissioners shall order a new nev election in like manner as herein provi provided led aed upon the completion of these duties the said commissioners ners shall return to washington and ani report their proceedings to the secretary of the interior whereupon said commission shall cease and determine sec see 11 and be it further enacted that every white male citizen of the united states over twenty one years of age ame who may be a bona fide inhabitant of salt sait said sald territory on the ath day of july 1856 and who shall have resided three months next before said election |
