The officer was soon on the ground and had his man covered with a Winchester rifle. Smith made a break for liberty, but a shot from the rifle brought him to time. He fell to the ground when the shot was fired, whether from fright or in a vain hope still to escape is cot known. He wan ordered to his feet and compelled to throw up his hands, and while Henroid kept him covered with his Winchester the boys unarmed and bound him. At no time did Smith show fight, although he was armed with a revolver. The slightest resistance on his part would have meant his death, as his pursuers were expecting a' desperate fight before the desperado would eubmit to capture. That he submitted so tamely is a surprise. After his capture Smith was taken back to the water tank, where it is supposed he had spent the preceding night. There he was held while a wagon was sent for to convey him to Eureka. The wagon was dispatched from Eureka in the forenoon.
