H. was given the tack this week of determining rights of more than 3000 water users to waters of Utah lake, Jordan river and all tributaries, in the biggest suit ever brought In the Etate. Tlie decision was the result of a supreme court ruling which granted a petition of Spanish Folk West Field Irrigation Company and other water users of Utah county, to prohibit the Third district court from adjudicating the waters until a determination of rig .ts had been made by the stale engineer. Removal, from the court to the state engineer, of authority to adjudicate the water was protested by Salt Lake City corporation and Salt Lake county canal companies on grounds they would lose rights granted them under the constitution If denied equity proceedings. It was these same Interests, who in 1936 brought the first adjudication suit against the present plaintiffs and all other users of tlie water. These interests Included Salt Lake Canal Company, South Jordan Canal ComEast Jordan pany, Irrigation Company and Salt Lake City. In the supreme court decision it is stated that the information supplied by the state engineer, a person who understands the determination and distribution of waters of the state, should serve as an aid to the court in making a more prudent determination of rights. The decision will affect other suits pending In the state where determination of water rights Is in question. In the immediate case it will mean the practical elimination of a law suit involving tremendous expci se to 3,000 water users and placing it in the hands of the state engineer. Thrfs was done in case of Weber rivVr. An appeal from the state engineer's findings may be brought by any aggrieved water user. VINEYARD (Mr8. Geo. F.
