In the case of the State of Utah vs. Peter Nichols, who wa9 tried last Wednesday and Thursday on the charge of grand larceny, the Jury brought in a verdict of not guilty. The cases of Sunrise Mining and Milling Co vs. the West Century Gold Mining and Milling Co. and the Gold Mining and Milling Co., were by stipulation continued for tbe Gol-cond- o term. Friday the court ordered that the names of eighteen more jurors be drawn from the jury box to serve as trial jurors at this term of court and to appear forthwith. Those drawn were: Frank Earl, Epliraim Jeppson, Leslie Nichols, Jos. It. Olseo, Thos. Crompton, Lewis P. Johnson, Moroni Edwin Phillips, Gilbert, George Nichols, C. D. Brown, Jos. P. Burt, Joseph Mortensen, J. C. Cutler, Lewis J. Anderson, Oluf Poulsen, W. O. Knudson, Vincent F. Davis and Geo. On H. Gilbert. Peter Rasmusspn and O. L. Wilcox were excused from serving as jurors. On Friday Richard W. Iloward was sentenced by Judge Hart to sixty days imprisonment in the county jail having been convicted of petit larceny. A decree of divorce was granted in the case of Ahigal C. Freeze Davis vs. John D. Davis; defendant ordered to pay costs of court. Joseph II. Watkins, J. M. Saunders and Vincent F. Davis were excused from further attendance as Jurors. The case of the State of Utah vs. Harmon Granger who was charged with Peter Nichols with the crime of grand larceny, the alleged offence being stealing horses belonging to' Rich and Pitt, came on for trial Friday and was continued to Saturday. District Attorney Nebeker and County saker vs the Oregon Short Line Ry came on for trial before a jury. J. D. Call appeared for plaintiff and Geo. II, Smith for defendant. The case was dismissed on defendants motion for non suit on the ground of lack of jurisdiction. - Louis Larsen was arraigned on the charge of robbery, an account of which appeared in last weeks News. He entered a plea of not guilty. The case of E. A. Valentine vs the 0. S. L. Ry Co. was ordered dismissed Geo. 'Nichols was excusdd from further attendance as a juror. On Tuesday tbe case of Margaret Ann OBrien vs. The Consolidated Mining and Smelting Co. et al. came on for trial. This Is a suit for wages claimed to be due James OBrien and Charles Bra uel and assigned by them to the plaintiff in this action. Nels Jenson appeared for plaintiff and Jas S. Perry and T. D. Johnson for defendants. The amount sued for approximated 12,000, but the Jury brought in a verdict last uight for 951.11. Tbe defendant gave notice of a motion for a Co. new trial. The Other Side- Editor Box Elder News, Dear Sir: Having been a subscriber of your paper from the beginning aud having noted the spiritof fairness with which you handle all subjects brought to your notice, I ask you to kindly allow me 6pace in your valuable paper to make known to the many readers our side of tbe case. The truth must, of necessity, change the tide of thought. It is an easy matter, through misrepresentation and agitation to influence the people to act hastily and many times unwisely. I think I am safe in saying that had the truth been presented to the people in circulating those petitions and at tbe mass meeting held on the 12th lust, the senti ment would have been different. There are, perhaps, We make a Specialty but very few people who know they would be compelled to condemn our present system as they codsidered the people were entitled to something better. One year ago last February they gave a stranger by the name of Sweet, (a circumstance the readers will remember) a franchise for 25 years for the mere asking for it. Shortly after Mr. Sweet secured this franchise he came to us offering to sell it for 9500, showing that he obtained the franchise for no other purpose than speculation, proving to be a promoter, which, no doubt, was Bomewhat to the city council. However, his actions was the means of opening the eyes of some of the stockholders of the B. C. E. Co. to an extent of at least investigating as to the feasibility of putting in an plant. After careful investigation on the part of some of the stockholders, it was decided that the project was a feasible one and that it might also prove remunerative as an investment. The next step taken was to consult an attorney as to what steps were necessary in order to acquire a right to the use of the waters of Box Elder creek for power purposes. We then found it necessary to employ a hydraulic and electric engineer to make a preliminary survey to obtain data that he might furnish an estimate of the approximate cost and direct ns aright in the selecting of pipe lines and selecting of dam sights. After obtaining the necessary information on this subject we set to work to survey a level line through the canyon to ascertain what head could be obtained and to measure the water at several points through the canyon to ascertain the flow per second so that we could ligure on the size pipe it would require to carry all the water during tbe ting season. On r next obstacle was to find a suitable dam sight, our engineer informing us that it was absolutely necessary that we get bed rock for our dam. After working in several places we discovered a good dam sight and set to work laying bare the bed rock. After satisfying ourselves that we had found the right place for a permanent dam we purchased a quarter section of land through which the pipe line will extend and had our sur- After remaining here a few days, Mr. Eddy expects to visit his parents in Victor, Colorado.
