Ba 1 Uankrupt ?tock it ordained by the City Council of SpnnLh Fork City: That no person shall manufacture, sdl, barter, deni out, or otherwise dispose oE any spirituous, vinous, malt, or other intoxicating liquors, without first obtaining front tne city council a license, as here- Must be closed out at once at prices to Suit, inafter provided. Sec. 2 A manufacturer, ns contemplated in this Ordinance, is one who manufacture!. any of the liquors mentioned in tho preceding section, nnd yho Bella tho sumo at wholesale, as follows, If in kegs, not le. s than two gallons if in bottles, not less than one dozen; Provided, That no liquors so sold, either in kegs or bottles, or otherwise, shall fie drank on tho premisos where manufactured. A wholesale dottier, as contemplated is this Ordinance, ia one who sells, or otherwise disposes of, any of said honors in any quantity, not to be drank on the premises where sold. A retail dealer, ns contemplated in this Ordinance, ij one who sells or otherwise disposes of anyof said lienors mentioned jn this Ordinance, in any quantity, and by the glass or drum, to bfe drunk on tho premises or otherwise. Sec. 3 The City Council of Spanish Fork City is hereby authorized to grunt licenses, as contemplated in Sec, 1 of this Ordinance, to years, upon an application being any person over the age of tvyenty-onmade for such license by petition signed by the applicant and iiled with the City llecordpr. Said potitiou must state definitely tho particular place at which any of the liquors named in Sec. 1 of this Ordinance are intended to be manufactured, sold, bartered, dealt out, or otherwise disposed of, and whether he intends to manufacture or carry on a retail or wholesale business, Defure granting tho applicant a license he shull execute a bond to Spanish Fork City, conditioned that during the continuance of li is license he will keep an orderly and well regulated house, that he will not allow' gambling with cards, dice, or any other device or implement used in gambling, within liis house, outhouse, yard, or other premises under his control, that he will pay all damages, fines and forfeitures which may bo adjudged against him under atiy of the provisions of this Ordinance. Said bond shall be in the sum Of Seven Hundred und Fifty Dollurs (750), with tvyo or more sureties, (neither of whom is engaged m the business of selling liquors) to bo approve by the Mayor; such sureties must justify under oath before some pdjeer 'authorized tp administer oaths, that (hey are residents within tho Stale, und worth the amount justified to, pyey am above all their debts and liabilities, exclusive of property exceyapt from yxecu tiou. Such justification shall be in writing, signed by tba person just ifying, aud certified to by the officer who administered the oath, and attached to and filed with the bond; lrovided, that if any application for eucli license may be refused for good cause, ill the discretion of the city council, and that no such license shall be granted to any establishment, except a hotel, located within two hundred feet of any church or public school budding, being used for that purpose, or within tifty feet of any theater, variety theuter, concert hall, or any other like place of amusement. Sec. 4 The followiRg . rat are hereby established, upon which license muy be granted t .applicants therefor, within this city; 1 License for a manufacturer per year, 500; 2 License for a wholesale dealer per year, 500; 3 License for a retail dealer per year, 000; Provided, That no license shall be granted for a period of more or less than one year. And all licenses for tho same class of business shall be uniform in amount. Sec. 5 The applicant shall pay into the city treasury the amount required for said license, and, upon receiving the treasurers receipt, shall present tho same to the city recorder, who shall issue to the applicant a certificate of license, which certificate must state the name pf the person licenced, the place of busiucss, the kind or kinds of liquor to be manufactured, sold, bartered, or otherwup disposed of, t lie date of commencement and expiration of said license, whether it is for a manufacturing or a retail or a wholesale business, that the person named therein is dn)y authorized to carry on the business of manufacturing selling, bartering, or otherwise disposing of intoxicating liquors at the place and for the time specified therein, and that the license is not transferable. Said certificate shall Ik? signed by the mayor and city recorder, who shall seal the same with the seal of tho city. Sec. 6 Whenever any condition of said bond shall be broken, a new bond shall be required by the city council, and also iu case of death, insolvency, or removal, of either of the sureties and in any other con tingeney that the city council shall determine requires it. It shall be unlawful for any person to sell any of the liquors mentioned in this Ordinance after being notified by the citv council, or by its order, to procure a new bond, and until said bond shall have been executed, approved and Iiled with the nroper officer. Any person who shall sell, or otherwise dispose of, any of said liquors, w ithout first having obtained a license, or in violation of this section, shall be deemed guilty of an offense, and upon cony icl ion thereof, shall he fined in attv sum less than One Hundred Dollars, or he imprisoned not exceeding One Hundred days, or both fined and imprisoned. tW. 7 Any person licensed ns herein provided, an any person to act, us his clerk, agent, servant, employe, who or '...ill give, sell, or otherwise dispose of, uuy intoxicating drink, or tu;y of the liquurs mentioned in this Ordinance to any Indian, insane or idmdie person, or to auy minor, apprentice or Ptuploye, under twenty-on- e years of age, or who shall permit any of said persons to be anil remain in his idace of business where liquors are sold, without the written consent of the parents, guardian or employer thereof, shall bo doomed guilty of an otTense ami upon conviction thereof, shall be fined in any sum Ios than Due Hundred Dollars, or be imprisoned not exceeding One Hundred daya, or both fined unit imprisoned. Sec. 11 Mverv person licensed as herein provided, and any imrsOi, acting, or ussiuniug to act, ns his clerk, agent, servant or employe, wliq shall give, sell or otherwise dispose of, any of lio liquors mentioned j; this Ordinance on the first day pf the week, commonly called Sunday or ou any election day, either general or special, fur the election oi either State, county, precinct, municipal or district officers, except school trustees, or on any day upon which the mayor shall by proclamation forbid the giving away, selling or otherwise of any of said liquors, or during any of the hours of any day after 11 oclock p. m., ami before 5 oclock a. in., or the following diy, or who shall neglect mid fail to close and keep closed, bis place of business where said liquors are sold, durir.g each and every one of said days und after ll o'clock p. m., and before 5 oclock a. in. of every day as aforesaid, or so use screens, blinds, doors or other obstructions as to prevent a dear and unobstructed view of the whole interior of such room from the outside, nnd from the street upon which said room fronts during any and all of the time in which the person so licensed is forbidden to sell intoxicating liquors, shall lie deemed guilty of an offense, and upon conviction thereof shall bo liable to a tine in any Bum not exceeding Ono Hundred Dollars, or to be imprisoned in the city jail not exceeding One ILindrd days, or to both fine and imprisonment. The word dosed in this section shall be construed to upply to tho buck door or any other avenue of ingress or egress as wdl as to tho front door. Sea. 12 Every person licensed as herein provided, who shall keep, or permit to he kept, uny billiard, pool or curd table, pm alley or ten pin idlev, or table and ball alley, in any room where liiiuors are Bold undtir this Ordinance without first having obtained a license for such billiard or pool table, or card table, pin alley or ten pin alley or table and ball alley, and every proprietor or person in charge of any of said tables nr alles, who shall allow any minor, under the age of twenty, ono years to engage in uny game, or be nnd remain in tip) room or about the premises where any of said tables or alleys are kept without tho written consent of the parents, guardian or employer thereof, is guilty of un offense, and upon conviction thereof shall ho liable to n tine in any sum not exceeding Ono Hundred Dollars, or to be imprisoned in the City jail not exceeding One Hundred days, or to both line uiul imprisonment. Sec. 13 Whenever any condition of the bond herein provided fur shall be broken, or any provision of this Ordinance shall bo violated the City Council may, by order or resolution, declare the bond forfeited nnd the license revoked, und uny person licensed as aforesaid, who shall give sell, or otherwise dispose of uny of said liquors, after being duly notified by the City Council, or by its order, that said bond lms been forfeited and said license has been revoked, shall be deemed guilty of an offense, and upon conviction thereof shall be tiinsl in any sum less than One Hundred Dollars, or be imprisoned not exceeding One It mill red days, or both fined and imprisoned.
