On the Sd of August the people of Tooele county, Utah, at a regular election, elected Lawrence A. Brown to the- office of Probate Judgt of said county. On the 17th of August the Probate Judge elect, having duly qualified ,by executing the bond required by law, presented said bond to Thomas Atkins, th Treasurer of Tooele county, and demanded that it should bo approved and filed. Atkins refused to comply with this demand, assigning as his reason the alleged fact that the election of Brown would tested. The matter being brought before Chief Justice McKean upon an applies-tio- n for a writ of mandamus commanding Atkins to approve and file the bond, a decision was made to the effect that Brown bad a right to the possession of thv office; that the supposed or real fact that his right to the office might or would be contested was a fact with which the defendant had' nothing to do and furnished no valid excuse for his refusal to approve and file the bond.
