The Sheriff arrived, and, walking up toward Kirk, said : Herp, George, what are you doing ? At this Kirk turned toward him, drew a revolver, and withr the remark, Who the h II are you ? fired upon .Sedgwick, the ball taking effect in the leg and breaking it. He was arrested for the act, but the Sheriff refused to prosecute, and the uow full fledged was turned loose upon the fighter Next he turned up in community, Storey county, in the early days of. the Washoe excitement, and soon brought up in.tht3 Territorial Prison for robbery.
