" Dawes said the suggestion from the proper authority that it was necessary for us, instead of retrenching to borrow money to meet current expenses, would be a fatal blunder for our credit abroad. He continued: "I fear that a reduction in the estimates may not be much. If I have my way about it my knife would go into that book of estimates, and with the conviction in my heart that I would not be imparing the publio service one atom, until the difference between the current receipts and current expenditures would no longer exist. The book of estimates is a marvel to me. When I take up that broad book, so unlike that which I used to carry here under my arm, it is almost unintelligible to me. The only thing about it I can realize and understand is that year after year, the estimates are going on increasing until this year, in the face of this exigency, the grand total of estimates is about twelve millions more." Cox suggested that the ways and me ins committee might sit during the holidays, to consider the reduction of the tariff on certain articles which all knew would increase the revenue. Butler, in reply to Dawes' remark about injuring our credit jn Europe, said: "We have had too much credit in Europe. We have had it until we are now sending o millions m gold every year to pay interest to them, and the quicker they stop taking bonds the better." Garfield questioned Dawes as to the propriety of informing the country of he proposed taxation so long in ad vance, and Dawes replied that the committee had agreed to keep the Secretary's letter secret, but in the meantime the whole thing was published in a New Yerk daily. At the close of the debate Garfield's resolution was adopted. Dawes offered a resolution to adjourn over trom Tuesday, the zza 01 December, to Monday, the 6th of January. Schofield made an amendment extending the Adjournment from Friday, the 19tn of December, till Tuesday, the 6th of January. The amendment was agreed to and the resolution was adopted. decided The Supreme Court the case of the Union Pacific Railroad against Penniston, the treasurer of Lincoln county, Nebraska, on appeal from the Circuit Court of that State. Judge Strong delivered the opinion, the Court holding that the taxing power of the State is an attribute of sovereignty that exists independently of the Constitution of the United States, and not derived from that instrument, and that it may be exercised to an unlimited extent on all property, trades, business and vocations, existing or carried on within the boundaries of a State, except so far as has been surrendered to the Federal government, either expressly or by necessary implication; the court, therefore, sus tained the right ot the state or Nebraska to tax the property of the U. P. &. K. within the boundaries of said State. Judge Bradley read a dissenting opin ion, bold that the tax was an unlawful interference with the instrumentalities created by the national Government in carrying out the objects and powers conferred on it by the constitution. If a roadway be taxed it may be seized and seld for nonpayment of taxes in parts and parcels, and thus the whole purpose of Congress in creating the corporation and establishing the line may he sub verted and destroyed.
