The Assessor and Collector on receiving the tax list for collection shall furnish to each tax payer, or leave at his usual place of residence a written notice of the amount of tax due from him, and any person neglecting to ray his tax for twenty days thereafter it shall be deemed a refusal. In case any person refuses to pay his tax when required, the Assessor and Collector is hereby authorized and empowered to collect the same by suit in the corporate name as other clebtH are collected in actions at law, and the assessment roll shall in all such cases bo evidence on the part of the corporation. . Sec. 24. All taxes and assessments, general or special, levied or assessed by the City Council under this ordinance shall be a lien on the real estate on which the same may be opposed, voted or assessed, for two years from and af ter the corrected assessment roll shall have been, confirtnod; and no sale or transfer shall ailed the lien. Sec. 25. The Assessor and Collector is required and empowered to collect taxes at the rate of the previous year from any person he presumos will remove from the city before the regular time for collection, and to assess any person or property, omitted during the time for assessments, and must report his doings under this section, in the same manner as though done within the regular time. The Supervisor of Streets shall, before entering on the duties of his office, qualify, and giye bonds with security to the said city in the penal sum of five thousand dollars, conditioned for the faithful performance thereof. Said bonds to be approved by, and with the oath or affirmation, filed in the office of the City Recorder. Sec. 10. Said Supervisor shall have power to appoint ono or more assistants, as he may deem necessary, for whoso acts as such assistants he shall be responsible, and may remove the same at pleasure. Sec. 41. It shall be the duty of the Supervisor to see that all ordinances of eaid city relating to the improvements of streets, sidewalks and ditches are complied with. It shall also be his duty to expend the road tax, undertho direction of said Council, and collect and expend the poll tax, if paid in labor, at such places as he may deem for the public good, otherwise as the Council shall direct. Sec. 37. It shall also be the duty of said surveyor when performing services for said city to act in accordance with the orders of said council or its author ized agent; and in all the-- services of said Surveyor the city shall have precedence. Seo. 80. He shall keep an account showing all claims placed in his hands for dolldction by said "city, all monies reoeiiecj by ,hii on account of the . city, and all paitients made by him to the City Treasurer, and a docket book in which he shall enter an abstract of suits, pending in'arty eonrt, and judgments for or against said city. He shall, at the end of each quarter, settle with the Auditor of Pubtifl Accounts, and pay into the Cjty Treasury all monies remaining in bid hands belonging to said city. Sec. 81. In case of sickness or other disability, said City Attorney may appoint, by approval of the Mayor, in writing, any other attorney at law to perform his duties until he can resume them." The person so appointed shall possess the same powers, and perform the same duties, as the City Atterney.for whioh services he shall be paid as per agreement with the Mayor. Sec. 32. The City Attorney shall report quarterly, or oftener if required, to the City Council the condition of the city's business in bis hands or control. The compensation or salary of such Attorney shall be determined by said Council. CITY SURVEYOR. Sec, 33. The City Surveyor before entering on the duties of his office, shall qualify, and give bonds with security to said city in the penal sum of one thousand dollars, conditioned for the faithful performance thereof. Said bond shall be approved by,"- and with the oath of affirmation fifed in the office of the City Recorder. SeoJ 84. It shall be the duly of said Surveyor to make and deliver to the City Recorder a true and correct map of said city, showing the strets, lanes and allies, lots, blocks and plats with the numbers thereof. There shall also be traced on said map in dotted rod lines the boundaries of the quarter sections, established by the United States public survey, on which said city is located. Said msp shall be not less than three ff t) square if qljdiaU' be denominated "The official map of Ogden City." Soc. 85. It shall be the further duty of said Surroyor to nurvey any and all tracts or parcels of lands, or grounds in said city, whenever called on for such purpose, provided the legal fees be tendered to him for such service, and give to the parties requiring such survey a certificate thereof, describing therein the plat, "block and lot and the qusntity of land contained in such survey, and for which certificate he shall receive fifty cents. Sec. S(p The fees of sail Surveyor for all services rendered as mentioned in the preceding section shall be five dollars per day,: and the compensation for all services rendered the city shall be determined by said council. Seo. 41. The City Sexton before entering upon the duties of his office shall take an oath, and give bonds in the pcual sum of five hundred dollars conditioned for the faithful performance thereof, said bond shall be approved by and filed in the office of the City Recorder. Sec. 45. It shall be the duty of the Saxton to take charge of the public burying grounds of said city, to see to tho digging of graves; furnishing of coffins, ami conveying the dead when called upon so to do by any person entitled to bury in said grounds, to keep a record of all deaths of persons buried in said burying grounds which shall come under his observation, or shall be reported to him by the citizens'of said city, winch record shall include the name of the person deceased, with his or her parents' names; where and when bom; the time of death and the cause thereof; together with the name of the physician or nurse who attended such person. See 46. Said Sexton is hereby aut hor ized to sell lofs in said grounds, and to collect all dues arising from such sales. He shall give to each purchasor of a lot or lots a certificate of payment therefor, and of the number of the lot or lots so purchased. And the Mayor of said city is hereby authorized to give a good and sufficient deed of , such lot, or lots to the puvcuasers i taoreoi ion .presentation., to him of the certificate as aforesaid. Tho price of said lots shall be not to exceed Ten Dollars. The Sexton shall quarterly report his doings under this section to the Auditor of Public Acconnts, and pay all sums of money arising from such sales into ihe city treasury. See. 51. Any person who shall disinter any body buried in eald grounds, ex- cept under the direction of said Sexton, or who shall injure any monument, shrub, tree, or other property, belonging to paid grounds or being thereon, shall be liable to a fine in any suiq not exceeding one hundred dollars, or to imprisonment not exceeding six months, or to both such fine and imprdsonmeut. Sec. 62.-Itshall not be lawful to inter in the buna,! grounds of said city the body of any person known to the law as a murderer. Any person, violating (he provision of'this section shall be liable to a tine in any sum nut exceeding one hundred dollars, or to imprisonment not exceeding six months, or both at the discretion of the court having juriddiu- ion. SEALER OF WEIGHTS AND MEASURES. Soc. 53, The Sealer of Weights nd Measures shall, before entering upon the duties of his office, take an oath and give bonds in the penal sum of one thousand dollars conditioned for the faithful performance of the duties thereof, which Slid bonds shall be approved by and filed in the office of the City Rocordr. Sec. 51. The Sealer of Weights and Measures shall twice in every year from and after the date of this erdinancv, at intervals not exceeding seven months, and oftener if required, examine and test the accuracy of all weights, measures, scales, or other things used by merchants for weighing or measuring anything bought or sold by them, to stamp with a suitable se'al to be prescribed by the Mayor, all weights, measures and scales so used, which he. inay find, conformed, or which, may be made to conform, to the standard preserved by the laws of this Territory, and to .deliver to the owner thereof a cortjfica'f of their accuracy. !Sc.55. CAFTAIN Sec. 64. The Captaiu of Police shall tefere entering on the duties of his office, take and subscribe an oath or affirmation to faithfully perform the same, which shall be filed in the office of the . City Recorder. 1 , Sec. 65. The Captain of Police shall have the direction and control of the Police of said City.
