The WASHINGTON, Union Pacific railroad is forming plans to resist the applicatoin of the Southern Pacific for a temporary lease of the Central Pacific properties pending a decision by the interstate commerce commission regarding consolidation plans of the western railroads, it became known today. A statement issued from the Washington office of the California Producers and Shippers' associa-toquotes Fred G. Athearn, western counsel of the I'nion Pacific, as being strongly opposed to the proposed temporary lease. Attorney Athearn asserted that perma nent separation of the Central and Southern Pacific systems, as decreed by the supreme court, will restore to California economic railroad independence. He added: "The supreme court has found and decided that the Southern Pacific Sunset route and the Central Pacific are competitive, that such competition should exist and has been suppressed and throttled by the Southern Pacific, and this decision was in the public interest. "The United States district court of Utah, which will proceed with the separation of the Central and Southern Pacific lines under the mandate of the supreme court, has very broad powers over the roads and in the exercise of such powers must compel such Joint and common use of rails and terminal fa cilities as will result in no disrup tion or service at alt or inconveni ence to the traveling or shipping public. To the contrary, it will re establish competition between the Central and Southern Pacific as In tended by congress, which will insure quicker and more efficient movement of California products and will give to producers and snippers of the state two strings to the bow in the matter of railroad transportation.
