That cry goes up, somewhere or other, whenever the Supreme Court knocks down a law. Where it comes from depends on whose ox is being gored. If Congress were freed from judicial restraint, then Congress would be the sole judge of its own acts, except as it might submit to being checked by the preseidential veto. To set up Congress as a dictator, without judicial restraint, would be to increase beyond accounting the menace of every d attempted raid on the Treasury, of every scheme to save the country, of every Fascist effort to suppress civil liberties. If Congress were subject to no restraint by the courts, we g could expect an era of legislation by that would make the traditional practice of trading tariff benefits look, by comparison, like high statesmanship. We should see a Congress rolling up expenditures but reluctant, as always (witness the bonus bill), to tax; a Congress therefore piling up the national debt to new heights, with inflation as the inevitable result. With no judicial veto possible, the way would be opened for a spending orgy, in the execution of new schemes of centralized government, that would build at Washington a more towering bureaucracy than ever. It is false to say that we have government by the Supreme Court. We have a government under a supreme law the Constitution with the Supreme Court sitting as arbiter when a citizen says that his rights under the Constitution are invaded. Uncle Sam A Record Spender ENVY 4948 South State Street 00000 The Granite High School will Coleridge Taylor's, "Death of Minnehaha" Thursday evening, March 12, in the High School Auditorium. The first part of the program will be given by the boys and girls chorus and orchestra. The second part will be the presentation of the cantata by a mixed chorus of 200 voices and soloists. This cantata was the crowning event of Mr. Taylor's career. It 13 portrays the life of an Indian village during the winter months and gives a very beautiful pic ture of the Indian's spirit toward the present life, and the PRESIDENT Roosevelt's indorsement of the merit system in selcting government employes does not contribute a new note to his philosophy of government. He has consistently advocated "the maintenance, strengthening and extension of the merit system, established in the competitive principles of the civil service act." But under his administration the civil service has leen progressively undermined. The White House has allowed Postmaster General Farley to put into full operation his scheme of "political clearance" designed primarily to build up a strong political machine. A considerable part of the responsibility for exempting about 99 per cent of the New Deal's employes from civil service regulations runs directly back to the President. The merit system is simply one of the forgotten principles which has been laid aside in practice. Washington Post. Now the excuse is given for limiting the. application of this appropriation to 3,500,000 unemployed and leaving the rest to the mercy of the states and local communities, that the entire amount has been spent and no further funds are availablle. In ohtcr words, $4,800,000,000 has been spent to meet half of the relief problem, which so good an authoriity as Lewis Douglas, former director of the budget in the Roosevelt administratis has estimated might have been provided for in its totality with a direct relief exepnditure of not more than $1,200,000,000. Four times this amount has been spent to give work to 3,500,000 unemployed and the remainder of the problem is abandoned. No more gigantic failure could be imagined. Manchester, N. II., Union.
