Waggoner. v,hich lease and bond. was assigned to the Hercules Mining company at the time of the formation of that incorporation. This company was afterwards merged into the Ajax Mining company, Snyder and Shields taking 30 per cent of the stock or 90,000 shares, of which plaintiffs claim 18,000 and 21,000 shares respectively belonged to them and weie held in trust by Snyder, Shields and Hoffman. Clays also asks for judgment for $5000 which amount in cash he claims is due him from defendants.
