It may be justly claimed that the scheme to avoid the above issue, strangle the truth and discredit us, is unworthy of attention, because uttered and signed by a tliutioui tirni, having neither legal existence nor responsibility. This is true, but we have to consider that this fact is not yet as fully and generally understood as it should be aud as we are resolved that it shall be, "legal advise" to the contrary notwithstanding. Tho assertion that "certain agents of Messrs. Sella Krothers" there being no euch firm as Sella Brothers fc Barrett-ha- ve offered for publication, or in any manner or form, any "billingsgate matter" against any person, or persons, is an alias, false and utterly scandalous libel. And we desire to here most positively announce that in this matter our agents are acting under our express instruc tions, direction and approval. In the righteous and imperative exer-s- e of the right of and solely to defend ourselves, our business, and our patrons against the inhuman assaults of mad and implacable cupidity, we have been ruthlessly forced to show, anu to prove ueyonu any at tempt at denial: That P. T. Barnum's alias surviving partner, who during Adam Forepnugh's life was his bitterest enemy and assail ant, is now the macuging owner of the Forepaugh show, or what re mains of it, anu is operating it in connection with the late Barnum show in a deliberate attempt to ruin and destroy all other tent entertainments, and tirstof all and more particularly ours. That his agents, doubtless Bpeaking with authority, have everywhere publicly boasted that he would, if necessary. squander half a million dollars to accom plish that purpose. That the unparalleled, reckloss and improvident manner in which the Forepaugh show, or what is left of it, is being handled; leaving rich, ample and uncontested territory oeinnu to follow us into the far West at certain BLd heavy loss, can le accounted for in no other wuy. That tho unheard of course pursued by the alias owner of the late Barnum show, in scrupulously abstaining form Fore advertising against the paugh show or what is left of it, while rushing its advertising cars great distances and at enormous expense against us to strengthen and succor the overmatched Forepaugh show, or what is left of it. is proof positive of this wolfish purpose, and so accepted by the press and public. That the dishonorable effort to conand ceal purpose and proprietorship, Bhirk responsibility by falsely advertis-ini-r another person as "Sole Owner" of the Forepaugh Show.or what is left of it, is further and incontestible proof of this hoggish purpose. That the fact that we have never in any way molested or interfered with the late Barnum snow, or intruded upon its Eastern territory, but as Western men, snd proprietors of an exclusively Western enterprise, depended solely for sup port upon Western patronage, and even then made considerable sacrifices to avoid contention, is conclusive proof of the unmitigated semhness and coyote animus of the managing owner of the Fore ate Barnum and the paugh, or what there is left of it, shows. That his unbroken silence iu the face of such cborges is tantamount to and his refusal to accept our bonahde offer of a $1010 a day bonus to exhibit either of the said shows against ours, day and date, that the public may decide the question of respective merit, is an absolute confession of judgment in our favor and undeniable proof of the unscrupulous and mendacious character of his advertising. And we may now add thot the resort to the empty bluff copied above clinches the whole matter. We have heretofore stated that this our ruin and conspiracy to compass in which wears drive us from a business today the oldest established firm was concealed under an alias, and that the real name of Barnum's surviving partner is not James A. Bailey, but McGinnis. This involves a serious reflection, and inasmuch as we are charged before you with falsehood, libel and bilthe lingsgate, we have submitted to you own affidavit of alias James A. "Everything 'personal' concerning me is loaded with legal dynamite. Touch me in type and I shall explode." "1 canuot deny what you may publish therefore you must not publish what 1 cannot deny." "IVrssnal and public rights are my sole property. Drop your pen and hold up your nanus. "Certain of my agents, by th secret and corrupt use of money, have bribed one or two blackguard publishers of blackmailing sheets, which the Sells Brothers never patronize, to print false and 'libelous' billingsgate against them, and which has been offered your columns as honest criticism, with very red head to it, but you must conceal the fact, as it makes me look even worse than the tools I employ." "Certaiu of my agents have been and are sneaking into editorial sanctums, and scandalously and 'libelously' whispering lying billingsgate derogatory to the character of Sells Bothers' agents, and you are by this timely notice warned to swallow and indorse it." When you come to think of it, sir, it does not seem sltogetber inconsistent that so much generosity, innocence and modesty should seek to bideits light under an alios bushel. Now, sir, we have no defense except the shield of truth and justice to inter-nos- e against any suit for damages. We stand by and shall never cast the stigma of rejection upon our inherited name. We are amply responsible for any obliga tion and assertion made over it, and we will assume the entire onus of anything puolished by any newspaper at our request. The question of libel suits and indemnification being in order, let us briefly consider the status of the equal ownership in which they are foreshadowed. "Barnum & Bailey" Barnum is no more. It he has any grievances they are now before the court of last resort As for "Bailey," in this connection there is no such person. Legally he has not the shadow of an existence. He is but the impalpable myth of a misnomer. Legal advice has been obtained upon this subject, but of what character does not appear. For instance, has it been decided that "McGinnis" shall sue in the name of and for damage inflicted upon "Bailey," or will Bailey appear in court to demand an auriferous plaster for the good name and reputation of McGinnis? Which will the court recognize, McGinnis as Bailey, or Bailey as McGinnis. Shades of Bacon,' what a puddle of technicality is here for pettifogging to wallow in. Truly, 'tis a pretty muddle as it stands, and so we will leave it, with this parting advice to the individual most interested, to n nroceedinirfi against everybody.every- where, and in every court forthwith, giving pieference to that state whose en. lightened and impartial solons have de clared that "the greater the truth the trreater the libel. We can prove everything we have stated, and a great deal more besides. and are more than anxious to do so. We concede this to be a rather safe defiance, as the leeal advice we have obtained upon this subject is unanimously of the opinion that Barnum & Bailey, or James A. Bailey, would be thrown out or any court in Christendom. If Mr. MoGin nis thinks otherwise, we hereby covenant and agree to pay all the costs of trying it on, if such does not prove tbe case. Undersuch favorable circumstan ces how can he refuse the opportunity of proving before Judge and Jury just how much reputation and commercial value attaches to an alias.
