About three weeks ago he committed an infamous outrage upon a little girL ten g years old, and she will be a sufferer on account of the scoundrel's assault.. Marshal Murphy thinks there is no doubt of his guilt. When the villain hud accomplished the dastardly deed he hipped for California at once. Mr. Murphy slated that he has no doubt that the officers here have done all they can t find his brother. He does not see that he can do more, and will go on thia morning with his prisoner and the boy who is with him, a brother of the little victim. He thought that as there are no dredging irons here to rake the river bed, he may send a set from Ohio to be used to search the river for his brother's, bodv, as it may be there. Marshals McLellan and Whetstone came in from another trip through Cache and Riche counties yesterday, where they rounded up three more "U. C." cases. Marshal McLellan arrested Robert Baxter at Wellsville, on a charge of U. C. He was held by Commissioner Goodwin, of Logan, under bonds of f 1,000 and his plural "wife" under bonds of 1200 as a witness. He also arrested Wm. Perry of Denver, one of that city's wealthiest and shrewdest capitalists and business men, is in the city looking after his extensive holdings in Ogden. The attorneys for the plaintiff appeared at 2 o'clock and inquired of the court if argument should proceed. The court replied in the affirmative. There then ensued a little tilt between counsel over the question whether t ie defendant could tile an answer and complaint both at once. Mr. Rhodes maintained that be could not and. Mr. Hdes showed no disposition to limit hiniFelf to a demurrer alone. On reference to authorities Mr. Rhodes conceded the correctness of Mr. Hiles' position and tne argument proceeded on the demurrer. The demurrer simply states that the bi of the plaintiff does not recite fa:ta enough to make s cause of action. This Mr. Hiles maintained briefly and positively. Mr. Miller argued to support his position, which ia simply the one h a siiie has stood upon all the time, an exclusive franchise, vested rights, a contract between the city and his company, and the impairment of said contract and the injury to his property that will be done by defendant if also allowed upon the streets with bis tracks.
