Visitors: Alice Smith, Craig Pfingsten, Sam Scott, Ron Wunderlich, Lary Carter, Carl Briscoe, Mark Dotson, Russell Smith, and Max Anderson Chairman Strong called to meeting to order at 8:02 p.m. MINUTES - Ross made a motion to approve the Minutes of the Apr. 1 9, 1 995 Ken seconded the motion. meeting. Motion carried. CONDITIONAL USE PERMIT Richard Henrie: He wants to have a temporary construction camp as it allows for in Zoning Ordinance 10.0-3- .0 He met with the already County Commission, he has the septic tank permits, permission to hook into cxisiting water, and permission from Noel Wood, the owner ofthe propaty located in Sec. 16, T30S, R10W. Ken made a motion to grant the conditional use permit with an anual review and the urKlaamli that they will clean it up when they are done. Larry seconded the motion. Four were in favor of the motion, Ross abstained from voting. Motion passed. CONDITIONAL USE PERMIT -Mountain Rock Twin Co.:Craig Pfingsten and Sam Scott were there to explain the operation of supplying ballast for the Union Pacific Railroad. The quarry would be located in the NW quarter of Sec. 14,T27S,R1 1W, where the rock would be crushed, then trucked to the old roundhouse area to be put on the train and taken to where it is needed. They are in the process of getting the permits from the BLM and Air Quality. They also discussed keeping the dust down. Larry made a motion to grant the permit upon the condition that they file a copy of the pennits they need with us in a timely manner, that there will be an annual review, and contingent on the Beaver County Commission's agreement on the County roads. Jolyn seconded. Four were in favor, with one abstention. Motion passed. ZONE CHANGE Advanced Development: They want to change A-2- 0 zone to 0 zone on land west of Milford City in Sec. 7, T28S, RIOW. They discussed the fact that the county cannot supply services and that Milford city would need to be contacted to supply those services. It was decided that a letter would be sent to Milford City informing them ofthe request we received and what action was taken. Jolyn made a motion to recommend the zone change to the County Commission provided the county is not responsible for services to that area. Scott seconded the motion. All in favor, motion passed. ZONE CHANGE-Alle- n Carter: Ken made a motion to table this until more information is available. Jolyn seconded the motion. All in favor, motion passed. ZONING ORDINANCE: They discussed whether to allow gravel pits in anA-2- 0 zone. Ken made a motion to recommend to the County Commission to change the ordinance to allow gravel pits as a conditional use in an A-2-0 zone. Scott seconded the motion. Four were in favor, with one abstention. Motion passed. ITEMS OF DISCUSSION: Max Anderson came to talk to the board about dividing has 25 acres into one acre lots. There is a 12" water line running right in front of his property. He was told to get some plans together and come present it to the board. Ken made a motion to adjourn at 9:35 p.m. Jolyn seconded the motion. Motion passed. Thtw minutes will be presented for approval at the next regularly scheduled meeting. Milford the for and Alice S.nith reporting Slagowski, 2. Ronald Wunderlich, Advanced Development, approached council about a Conditional Uae Permit granted by the County for a Mobile Home Park. Councilman Dotson motioned to accept ConditionalUie Permit, Councilman Thomas seconded, all Wesley Peterson, LaWanna Peterson, Warren Johnson and Alice Smith reporting for the Milford Monitor. 2. Mayor Wiseman stated that the purpose for this meeting was to discuss the Silver Sage Proposed Annexation. The Mayor then opened up the floor for discussion to the public. As there was no further business, meeting was adjourned at approximately 6:45 p.m. PUBLIC HEARING AUGUST 1, 1995 1. Mayor Wiseman called the meeting to order at approximately 6:00 Those in attendance were: p.m. 6. Zeke Hickman expressed to Council his wish to make a donation of some old farm machinery to the City of Milford. Councilman Thomas motioned to accept donation ofthe machinery, Councilman Carter seconded, all in favor. 7. Minutes from Jury 18,1995 were approved with one correction. In regards to Item 7, Councilman Sowers did not motion to have asbestos removed from old A T&T Building. His motion was to have the Department of Corrections prepare a bid for the asbestos removal, with removal cost not to exceed $1 000.00. 8. Councilman Carter motioned to approve applications for reduced rates. Councilman Smith seconded the motion, all in favor. 9. Councilman discussed possible negotiations for using an employee for approximately 5 days per month to help get a Dog Ordinance established for the city. As more discussion and information is needed, this issue is tabled until next meeting. 10. Recorder Sparling brought to the attention ofthe Council the need for Dental and Eye Care coverage for Chy employees. Chad Johnson Beaver County Commissioner, Paul Barton Beaver County Clerk, Craig Davis Beaver and Zoning Building County Administrator, Ken Yardley Beaver County Sheriff, Lester E. Prall State of Utah met with the Beaver City Council and discussed the need for a New County Jail Facility. The County presented a draft proposal for a 150 bed facility which would house appx. 25 County Inmates and 125 State Inmates. The County requested Beaver City deed to Beaver County a Councilman Thomas, Dotson, Carter, Sower and Smith, Recorder Sparling, Treasurer Netto, City Coordinator Swain, Leadman Whiting, Warren Peterson, Rob Adams, Neb Bedingfield, Rob Davidson, Bob Theme, Larry Carter, Dave Jennings, Craig Prinstein, Joe Barban, Norman L. Lamb, Don Alexander, James Slagowski and Abce Smith reporting for the Milford Tabled until next meeting. 1 1 . Councilman Carter motioned to have office staff purchase flags for the street display, not to exceed $250.00. Councilman Dotson seconded, all in favor. 12. Leadman Whiting asked Council about purchasing an Automatic Time Relay for City wells. Leadman Whiting feels that it can maybe work on both wells. An approximate cost would be $56.00 plus labor and rewiring. Councilman Sower motioned to have Leadman Whiting purchase the relay switch, not to exceed $500.00. Councilman Thomas seconded, all in favor. 1 3. Councilman Dotson motioned to have Mayor Wiseman sign Ordinance 695; Annexation of Territory to City of MilfonUSilver Sage Annexation) as soon as the annexation agreement 1 8 returned to the Milford City office signed by the petitioners. Councilman Sower-ye- s. Smith.-ye- s, Thomas-ye- s, Dotson-ye- s, Carter seconded the motion. Vote as follows Carter-ye- s, 14. Councilman Smith motioned to have Circle Four Farms insert K. Impact Fees into Policy Declaration and then to accept said declaration. Councilman Thomas seconded the motion, all in favor, with the exception of Councilman Sower who abstained. Lyte Hutehings, Contractor, presented a request for payment for construction work being done on the Senior Citizens building. Mayor Wiseman asked Recorder Sparling to contact Gary Zabriskie, Five County, to find out which steps need to be taken for payment to contractor. 16. With the passing of Resolution 9-Repeal Free Water Hookups, on Jury 1 8, 1995, Attorney Kanell advised Council to reflect applications by developers for free water and sewer hookups since no one has extended any sewer lines as of yet Councilman Dotson motioned to accept Attorney Kartell's advice, Councilman Thomas seconded, all in favor with the exception of councilman smith who abstained. 17. Myron Sessions, North Milford Haven, talked to the Council about a franchise easement by V P & L, which comes across his property by North Milford Manor, that was established in order to put in a road. He stated that U P & L wanted a 10 ft. easement. Sam Florence, U P & L, said that they would remove the pole and wire because a Franchise Easement Agreement was never signed by Mr. Sessions. Councilman Thomas motioned to have Attorney Kanell draw up a recommendation to change 2. Coordinator Swain brought to the attention ofthe Council inquiries about 20 ft. of property in Milford Heights Area. Mrs. Cook had issued a warranty deed and said property has now been mortgaged. The Quick Claim Died has been ' superseded with the warranty deed. The total loss for the City for said poperty is approximately $535.00.' I 23. Residents are concerned about unpermitted work going on in the city. Enforcement of this situation win be handled through the County Inspector andor the local Law Enforcement Agency. 24. Coordinator Swain asked Council to have Gale Snyder address subdivisions prior to meeting ofthe Council. All subdivision plats should be sent to her for addressing for 91 1 Emergency Services. 25. Council slated that is should be the responsibility ofthe Building Inspector andor City Engineer to make sure that the subdivision agreement is within ordinance. Coordinator Swain felt that before anyone can move into a subdivision, a cash or surety bond should be required for repairs done. The City, however, shouldn't require all improvements to be done at time of building permit purchase because of the destruction of streets due to the water and sewer protect. 26. Recorder Sparling brought to the attention ofthe Council, the need for changing the monthly amount payable by citizens to keep their water from being disconnected. In the past, this has caused many delinquencies for the Chy. With new rates being as they are, $50.00 per month is no longer feasible. Councilman Smith motioned to allow staff to raise the monthly payable to current bill 25 on delinquent amount owed to City. Councilman Dotson seconded the motion, all in favor. Unmetered water rates will also double, going from $50.00 to $100.00 per month. Since their are minimal unmetered users, Council has given office staff permission to contact said users to notify them so they may purchase a meter. 27. Councilman Sower motioned to have Carolee Gay act as Election Judge. Councilman Carter seconded, all in favor. It was also decided that the ballots would be counted by hand. 28. Councilman Thomas motioned to hire the temporary employees who have been working at the Chy Golf Course as full time employees. Councilman Carter seconded, all in favor. 29. Councilman Thomas motioned to accept Ordinance 7-Industrial Park of Territory. Councilman Carter seconded the motion. Vote as follows: Carter-Ye- s, Thomas-Ye-s, Smith-Ye- s, Dotson-Ye-s, d. 30. Resolution 1 1 --95: Fees for Land Development Applications will be reviewed and put on agenda for next Council meeting. 34. Councilman Thomas stated that since he will be moving out on the City Flats, if the Council wishes they can have someone else serve out his term. Attorney Kanell said that since his term Is almost at his up and because ofthe circumstances of living part-tim- e property in City, there should be no problem with his serving out his term. 35. Councilman Dotson motioned to allow Jennifer Carter, Manager of City Pool, to purchase new vacuum for the swimming pool, not to exceed $420.00. Councilman Sower seconded the motion, all in favor. The State offered help to the City with the Resource Target Team to identify impacts and find resources to meet the impacts.
