WHEREAS, the Beaver County Commission requested the Planning Commission to review the beaver County Zoning Ordinances with regard to swine husbandry units and intensive livestock operations: 0) and, WHEREAS, Beaver County Ordinance ' NO. 95-0-4 i WHEREAS, Randy Ruesch having petitioned for an amendment of the Zoning Map of Beaver County, Utah, as hereinafter set forth, and said petition having been submitted to the Beaver County Planning Commission for study, and WHEREAS, said Planning Commission having considered said and made its petition recommendation to the Board of County Commissioners with respect thereto, and WHEREAS, the Board of County' Commissioners having held a public hearing on the 3rd day of April, 1995, on the question of whether or not such amendment will promote the good order, health, morals and economy of Beaver County and it is in the best interest of the County and the inhabitants thereof: THE BOARD OF COUNTY COMMISSIONERS OF BEAVER COUNTY, STATE OF UTAH, HEREBY ORDAINS AS FOLLOWS: Section 1. CHAPTER 10.16 MULTIPLE USE DISTRICT (MU-4and CHAPTER 10.17 AGRICULTURAL DISTRICT (A) are hereby amended to read as follows: CHATTER 10.M MULTIPLE USE 0) DISTRICT fMIT-i- m 10.16.010 Purpose The purpose of Multiple Use Districts are to establish areas in mountains, hillsides, canyons, mountain vallevs. deserts, and other open and generally underdeveloped lands where human habitation would be limited in order to protect land and open space resources and to reduce unreasonable requirements for public utility and service expenditures through uneconomic and unwise disposal., ...... and ,t scattering ,, ,of population; to encourage use of the land, where appropriate, for forestry, grazing, agriculture, mining, wildlife habitat, and recreation; to avoid excessive damage to watersheds, water pollution, soil erosion, danger from brush land and to promote the health, convenience, order, prosperity and general welfare of the inhabitants of Beaver County! 10.16.020 Permitted Uses. (1) Agriculture and pasturing of livestock, except swine. (2) Forestry, except forest industry. 10.16 030 Conditional Uses. . (1) Single-fami(2) dwellings. dwellings. (3) Summer homes or cabins. (4) Airports. (5) Dude ranches, family vacation ranches. (6) Forest industries, such as sawmills, wood products plants, or others. (7) Golf Courses. (8) Livestock and agricultural industries and businesses. ic dams or facilities. (9) ( 10) Mines, quarries, gravel pits, and crushers, concrete batching plants or asphalt plant, oil wells or steam wells. (11) Private parks or recreational grounds or facilities, and private recreational camps or resorts, r including accessory of supporting dwellings or dwelling complexes which are owned or managed by the recreational facility to which they arc accessory or are under unified control. (12) Public uses; essential facilities. (13) Radio or television transmitting and relay station and towers. (14) Water pumping plants and reservoirs. (15) Temporary buildings for uses incidental to construction work, including living quartos for guards or night watchmen, which buildings must be removed upon completion or abandonment of the construction work, (16) Plants for the production of electricity, powered by whatever source is available. (17) Accessory buildings and uses customarily incidental to the above. (18) Keeping, raising, slaughtering or making swine. (19) Swine husbandry units. (20) Intensive livestock operations. ' (2 1 ) Other uses similar to the above and judged by the Planning Commission to be harmony with the character and intent of this zone. 10.16.040 Area Regulations The minimum lot area for any dwelling shall be forty (40) acres in the MU-4- 0 zone. 10.16.050 Width. Fmntar Varf and Height Regulations Width, frontage, yard, and height regulations shall be as required by conditional use permit or by Planned Unit Development approval, provided that no such requirement shall be less restrictive man is required to meet the purposes of the Chapter.
