It is the intention of the Board of County Commissioners to finance the cost of certain road improvements within the District and to levy a special assessment as provided in Title 17 A, Chapter 3, Part 2, Utah Code Annotated 1953, as amended, on the real estate lying within the District for the benefit of which such assessment is to be expended in the making of such improvements. Box 69 302 South Main Milford, UT 84751 Dear Mayor Wiseman: Subject: Notification of Ground Water Contamination Incidents Your letter of January 10, 1997, to Governor Leavitt regarding the notification process following Circle Four Farms' August, 1996, well contamination incident has been forwarded to the Department of Environmental Quality for response. Although normal notification procedures were followed in this case, we regret that this situation has caused unnecessary concerns to the City Council and citizens of Milford. As you have requested, in the future we will notify Milford City of any circumstances which could affect ground water quality in Milford Valley. But, when Vasily Zhurevlev, who just turned 40, and a world class lifter from Moscow, Russia weighed in at 196 lbs., he realized he had to drop 2 lbs. in a hurry. To have a better chance at a Stale Championship he opted to put in nine or ten laps around the track and do a lot of spitting and hopefully drop a couple of pounds. Thank goodness he made weight because Vasily lifted over 500 lbs in the 198 lb. category to establish himself as one of the top Masters Lifters in the world. program. 3. . We do not believe either of these incidents posed a risk to public or private wells in Milford Valley, because of Circle Four's prompt cleanup efforts, the distance to other wells, and the very slow rate of ground water flow. We would appreciate it if you made this information available to concerned citizens at the Milford City Hall. We are concerned mat the aquifers in Milford Valley have shown a long- term trend in decreasing water quality due to causes unrelated to Circle Four's facilities. This has been attributed to irrigation practices and inappropriate well construction in the valley (Utah DNR Tech. Pub. No. 43 (1974)). Wells zones have allowed water containing elevated perforated in many levels of salts and nitrates, and possibly pesticides, to move from shallow zones under cultivated fields into the deeper aquifers. As opposed to Circle Four's operations regulated under state ground water permits, which include stringent source" requirements for waste containment and monitoring, these discharges are not directly regulated under the state ground water protection following: ' jWI provided INTENDED IMPROVEMENTS ' ' 14110 SL(Sy.Utll (Ml) AifflRtimcnt Road Improvements $550 Per Acre Acreage ESTIMATED COST OF IMPROVEMENTS The total cost of improvements in the District is estimated to be $3,710,000 of which the County shall pay $130,000, leaving the ranaining $3,580,000 which shall be paid by a special assessment to be levied against the property which may be directly or rodirectly benefited by such improvements which benefits need not actually increase the fair market value of the property to be assessed. The property owners' portion of the total estimated cost of the improvements may be financed during the construction period by the use of interim warrants. The interest on said warranu will be assessed to the property owners. The estimated cost of improvements to be assessed by connection against the lots withm the District is as follows: ASSESSMENTS AND LEVY OF TAXE'i ybJL. ' 7frj . It is the intention of the Board of County Commissioners of the County to levy assessments as provided by the laws of Utah on all parcels and lots of real property within the District benefiting by the proposed improvements described herein. The purpose of the assessment and levy is to pay those costs of the subject improvements which the County will not assume and pay. The assessments may be paid by property owners in ten (10) annual principal installments with interest on the unpaid balance at a rate or rates fixed by the Board of County Commissionen, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment becomes effective. The assessments shall be levied according to the benefits to be derived by each property within the District. FOR FIT JNO PROTESTS Any person who is the owner of record of property to be assessed in the District described in this Notice of Intention shall have the right to file in writing a protest against the creation of the District or to make any other objections relating thereto. Protests shall describe or otherwise identify the property owned of record by the person or persons making the protest. Protests shall be filed with the County Clerk of Beaver County, Utah, on or before 5:00 p.m. on the 18th day of April, 1997. Thereafter at 1 :00 p.m. on the 21st day of April, 1997, the Board of County Commissioners will meet in public meeting at the County Courthouse to consider all protests so nied and near ail objections relating to the proposed District. After such consideration and determination, the County shall adopt a resolution either abandoning the District or creating the District either as described in this Notice of Intention or with deletions and changes made as authorized in bylaws; but the County shall abandon the District and not create it if the necessary number of protests as provided herein have been filed on or before the time specified in this Notice of Intention for the filing of protests after eliminating from such filed protests: (i) protests relating to property or relating to a type of improvement which has been deleted from the District and (ii) protests which have been withdrawn in writing prior to the conclusion of the bearing.
