Information On Difference in Farm Income for SS Do you get social security credit for your income from land you rent to someone else for farming? It depends on the rental agreement agree-ment and on how much you participate partici-pate in the operation and management manage-ment of the farm, says Kesler T. Powell, manager of the Provo, Utah social security office. Under some circumstances your Income from the land may be "rental income" and not covered by the law; under other circumstances circum-stances your earning will be considered con-sidered "earnings from self-employment" as a farmer. If you simply rent the land in return for cash or a share of the crops or livestock, and you take no part in the production or management man-agement of the production of the crops or livestock, then the cash or crop share you receive is rental income and it does not count toward to-ward social security. But for taxable years ending after 1955, you can get social security secur-ity credit for your income from land you rent to someone else under an agreement that you will "materially "materi-ally participate" in the management manage-ment or production of the farm commodities. What do you have to do to "materially "ma-terially participate;' in the management manage-ment or production? First, there must be an arrangement arrange-ment between you and the renter that you will take part in the management man-agement or production. This arrangement ar-rangement may be either written or unwritten. Second, you must actually take some part in the production or management of the production. Even if you don't actually do any physical work, you may be materially materi-ally participating in the production or management of production if you: Advise and consult Regularly with the person who rents the land in the operation and management Of the farm. Inspect the production activity regularly, Furnish part or all of the equipment, equip-ment, machinery, or livestock, Pay part of the expenses of production. Mr. Powell pointed out that each of these must be considered,- together to-gether with any work you may do-on do-on the farm and management of the enterprise. It's not necessary that you do everything listed above o qualify; in some cases it it sufficient if you have an arrangement arrange-ment to participate in the farming and you actually perform some of the activities. For further information you may contact a representative of the Social Security Administration at the County Office Building. Delta. Utah, on November 30, at 10:00 ajn.
