BE IT ORDAINED BY THE CITY COUNCIL OF OREM CITY AS rOLLOWSt ARTICLE I. ZONING COM. MISSION AND BOARD OF , ADJUSTMENT. Section 1. Zoning Commission. There Is hereby createa a -Owing commission of seven members, mem-bers, one to be designated from among its own members by the City Council, one to be the engineer en-gineer of Orem City, and one to be a member of the Board of Adjustment of Orem City; the other members to be appointed ap-pointed by the City Council from among the qualified elec tors of said city. The term of office for the &. designated City Councilman and for the City Engineer and mem ber of the Board of Adjustment) shall correspond to their respec- ."'41. .a .niiwA i Th farm of office for the first appoin tive members of such commission commis-sion shall be three, four, five and six years; one to be appointed ap-pointed for three years, one to be appointed for four years, one to be appointed for five years, and one to be appointed for six years.'- Thereafter, the terms of office for each appointive menv ber shall be six years. Vacancies Vacan-cies occurring otherwise than through the expiration of terms i shall be filled by appointment by the City Council. , Members may be removed after aft-er public hearing by a majority vote of the City. Council. Menv a bers shall be selected without respect to political affiliations and shall serve without com pensation. , Section J. Duties. Powers, - Reports, Hearings. It shall be the duty of the ; zoning commission and it shall . have, the power to make rec- -v omendations to the City Council for the toning of Orem City . by dividing such municipality into districts of such number, shape and area as may be best 'suited to make effective thai proper coning of said city, and , to provide within said districts - for the regulation and restriction, restric-tion, of the erection, construe tion, reconstruction, alteration, repair or use of buildings, structures struc-tures and land, all of such regu lations to be uniform for each class of kind of buildings throughout the district, but " such regulations in one district v . may differ from those In other ; districts. Section 2. Enforcement. (1) The Building InsDectm appointed under the provision! of the Building Code of Orem City, is hereby designated and autnorizea as me omcer chars, ed with the enforcement of this ordinance. (2) From the time of the ef. fective date of this ordinance, the Building Inspector shall not grant permit xor tne construe tion or alteration of any build. ing or structure if such con. struction or alteration would be in violation 01 any of the pro-visions pro-visions of this ordinance; nor shall any municipal officer grant any permit or license for the use of any building or land if sucn use would be in violation of any of the provig. ions of this ordinance. Whenever When-ever a permit is refused because of the violation of some provis ion of tnis ordinance, the reason for refusal shall be clearlv stated in writing by the Building Build-ing Inspector or other municipal munici-pal officer. (3) All applications for building build-ing permits shall be accompanied accompa-nied by a plat in duplicate drawn to scale, showing the at tual dimensions of the lot to be built upon, the size and location loca-tion of the existing buildings, buildings to be erected, and existing ex-isting buildings on adjacent property, and such other infor mation as may be necessary to provide for the enforcement of this ordinance. A careful record rec-ord of such applications and plats shall be kept in the office of the Building Inspector. (4) The Building Inspector up on accurate information in writ ing from any citizen, or upon his own Initiative, may institute any appropriate action or proceedings pro-ceedings in the name of Orem City to prevent, correct, re strain, or abate violations of this ordinance. Sec. 3. Certificate of Occupancy (1) No land shall be occu pied or used and no building hereafter erected or structurally altered shall be occuped or used In whole or in part, for any purpose until a certificate is issued by the Building Inspec tor stating that the building and use comply with the provisions of this ordinance and with the Building Code of Orem City. No such certificate shall be Is sued unless the building and its uses and its accessory uses and the uses of all the prem ises are in conformity with the provisions of this ordinance and with the Building Code. (2) Certificates of occupancy shall be applied for coincide tally with the application fori building permit, and shall be is sued within ten (10) days alter the lawful erection or altera-ion altera-ion of the building is completed and a request for such permit is made by the applicant. Section 4.
