Show Thursday, September 27, 1 979 5 Page 7 New Savings Breaks Ground Groijnd breaking for the Summit Savings Building, located at 1750 Park Avenue, took place on Tuesday, September Sep-tember 25. The building will be occupied by the Summit Savings and Loan Association, an independent and locally owned savings and loan. The building is scheduled for completion in May of 1980. During the construction con-struction phase of its permanent per-manent quarters, the savings and loan will operate from a temporary office located on the northeast north-east corner of the building site. Covenient access to the temporary office is available ' from Park Avenue or Homestake Road. The association is in its final stages of organization, and according to Dean S. Berrett, president, expects to be open in October. Ser-' ving on the Association's Board of Directors are Frederic N. Spidell, Chairman, Chair-man, William F. McComb, William D. Park City's Mayor Jack Green said Wednesday the building appears to be in compliance with city requirements, re-quirements, and construction construc-tion will continue. The eight-plex, owned by local developer Jack John-. John-. ston, has been the source of controversy for several o weeks. Earlier in the month a stop work order was issued when dirt fill blocked Olive Branch Road fronting the building. But the major source of contention has been the building's height. According to local zoning ordinances, or-dinances, the building must not exceed 28 feet above natural grade. Several concerned con-cerned citizens, including neighboring property owners Mary and Ray Leh-mer, Leh-mer, claim the building is in violation of that requirement, require-ment, as well as not complying comply-ing with legal front-yard front-yard setback standards. Mrs. Lehmer appeared at last Thursday's City Council meeting asking that City Attorney At-torney Mike McCoy authorize a stop work order for the eight-plex because of its code violations and because Olive Branch Road does not meet minimum city standards for a public street. Mayor Green commented at the meeting that the city's land management code definition of 'street' is "ambiguous" "am-biguous" and difficult to enforce. en-force. "It has never been enforced enfor-ced in any other area of the city," Mayor Green told Mrs. Lehmer. "We've discussed stopping this project and getting an injunction. injunc-tion. But we want to be more sure of our ground." , City Attorney Mike McCoy noted, "The height is not the problem. There are a number num-ber of people employed by the city that say the building is not 28 feet. The road is the problem, and it needs to be looked into. Stopping construction con-struction right now could possibly cause litigation." On Tuesday, the group of seven made an on-site inspection in-spection to decide the legality of the project. Included In-cluded were City Engineer John Probasco, Mayor Green, McCoy, Building Inspector In-spector Bob Skanter, Planning Plan-ning Commissioner Roy Reynolds, Ray Lehmer, and Keith Green, supervisor of various city capital improvement im-provement projects. On Wednesday Mayor Green commented, "We think all the requirements have been met," though he conceded the road mav not be 25 feet wide in some places. He added add-ed that McCoy has cautioned that a stop work order issued because of the road requirements most likely would not be upheld in court. Enforcing the 25-foot requirement would have a negative impact on new development in the older part of the city, the mayor said, because many streets could not comply. "Mike wants to do more research before we make a recommendation," . Green said. "The land manage ment code is ambiguous relating re-lating to height limitations. It refers to natural grade. How do you determine natural grade?" The mayor commented that the Utah Uniform Building Code contains a more specific definition, and may be incorporated into Park City zoning codes in the future. "This has cost the citv more than $1,000," Green ; said. "We have addressed j for Mary (Lehmer) the water, fire protection, soils, roads and setbacks. Car .Disappears A car valued at $3,600 disappeared from in front of the home of a Park City woman last week, and it has yet to be recovered. Patricia Ann Greene told the Park City police she parked her 1978 Toyota Corolla in front of her residence in the 700 block of Woodside September 21 and later discovered it missing. The police have no suspects. In other police action : An unidentified teenager is suspected of the theft of cash and clothing valued at $665 from three Park City men. Ed Mechling, John Roberts and Kent Wilson said a white male about 18 years old stayed with them at their home near 1330 Park Avenue, and is suspected of stealing the items September Septem-ber 21. " A cassette deck and speakers were stolen from the car of a Salt Lake City man parked in a gas station sometime between September Septem-ber 16 and September 18. Tom Reinerth told the police he had car trouble and parked his vehicle in the Conoco station on Highway 224 until he could return to repair it.
