He must obey the law, .which states that a public road cannot be vacated unless all abutting owners sign a petition for vacation and following a hearing by the governing authority in which it is determined that vacating the road is not detrimental to the interests of the public, or, alternatively, any abutting abut-ting owner may file a petition for vacation, notice of which intended vacation must be published in the newspaper once a week for 4 weeks, following which a public hearing must be held in which the governing authority must find that the vacation is not detrimental to the interests of the public. The Depot project followed none of these procedures required by law. The Citizens Council action requested the city council to follow legal procedures before any public street is to be vacated and to conduct an impact study first to determine deter-mine the effect the loss of such a public street would have on the city if closure was effected thru vacation. The Depot project was cited as an illustration of an owner being allowed to close a public street without following legal procedures. How can this action requesting the city to follow the law and exercise sound judgement before entertaining enter-taining a vacation be considered con-sidered reactionary and polarizing? The second matter presented presen-ted at the Sept. 6 'meeting was proof that the parcels of land annexed into the city by the council on May 7. 1979 If. Her "no" vote made it clear that she alone stood on the side of upholding the law, as she swore in oath to do. If the editor (and maybe others) have been lead (sic) to believe that the Citizens Council is reactionary and is polarizing the community, I can only believe he (and maybe others) have been taken in by the unfounded charges and name calling hurled against the Citizens Council by the realtors and developers who packed the last city council meeting.
