If a winning team is indicated on the tie-breaker, but no score is given then the pick will be counted in the initial scoring, but will be given last place in tie breaker determination. 7. Ties will be broken by using the tie breaker, the person with the smallest point differential between actual scores and predicted scores will win the tie breaker. If after using the tie breaker there is still a tie, then whoever had the closest score to the winning team will be the winner. win-ner. ' Texaco Inc. is negotiating with the Mellon Foundation to sell the surface rights to its oil shale property proper-ty on the lower McCook Ridge and Swcctwalcr-Bittcr Creek drainages. "Receivership of this tract and subsequent management activates would prove extremely beneficial for herd recovery," said Walt Donaldson, northeastern DRW regional supervisor. It would add to the 450,000 acres which is managed with participation participa-tion from the Bureau of Land Management, state agencies, private pri-vate property owners and private groups. In a letter to Governor Mike Leavitt, in opposition to the lands transaction, Uintah County Commission Chairman Glen McKce states that wildlife is only one resource among many in the energy-rich and livestock-supportive Book Cliffs. "Uintah County is fighting for its economic survival," McKee said in the letter. The county "cannot identify iden-tify in its revenue data where exclusive exclu-sive 'wildlife' and 'riparian habitat' preservation has eveY been, or conceivably con-ceivably could be, the county's economic eco-nomic salvation." Also, McKee contends the county will loose rollback tax when the property is sold. The rollback is required at the time of purchase and is about $21,000 in the case of the Texaco property. The rollback is determined by the difference in taxes for the last five years the property is on greenbelt and what would have been paid in tax without with-out greenbelt. Greenbelt allows a farmer or rancher to pay faxes on the production produc-tion from the land and not the fair market value of the land. McKee also notes the conflict of split-estate ownership with DWR owning the surface rights and Texaco continuing continu-ing to own the mineral rights. Under Utah law the mineral estate is the dominant estate. "Is the DWR proposing to purchase the Texaco interest in the face of this dominant minerar-estate theory and then attempt, to prevent mineral access when the mineral rich subterranean strata are eventually developed?" Upon acquisition, the Division would manage the property to enhance big game populations within with-in the supportive guidelines of multiple mul-tiple use. "Existing technology, according to local sources, suggests that oil can not be extracted from these specific reserves at competitive world market mar-ket levels." Valentine said.
