Show Damage Suit Results In Hung Jury The civil suit in district court last week, involving damages in a truck-cow collision south of Beaver, Bea-ver, resulted in a "hung" jury and the jurymen were excused. The case was that of Orren E. Hale of Salt Lake City, against Albert T. Smith of Beaver. The collision occured December 4, 1958, a short distance south of Beaver and Plaintiff Hale was suing for $3062.88 special and $1500 general damages, plus legal interest and court costs. The case went to the jury Wednesday afternoon and at 3:45 p.m. the jury returned to submit a question to the court, then resumed resum-ed their deliberations. A 7:45, the jury returned and reported to the court they had not arrived at a verdict and were unable un-able to do so. The court then submitted sub-mitted four interrogatories to the jury and they resumed their deliberations. de-liberations. Later, they announced they were divided, four to four, on the interrogatories. The members were duly polled and then excused. The interrogatories were filed and the case continued, subject to further fur-ther order of the court. Present for the trial were Dis- trict Judge Will L. Hoyt of Nephi, Court Reporter J. H. Keller, and Clerk C. Victor Smith. William S. Richards was attorney for Hale and Durham Morris represented Mr. Smith. Thursday, there came on for pre-trial hearing the case of George C. Goodwin et al., vs. Russell Mayer May-er et al. D. A. Skeen appeared as counsel for the plaintiff and Sam Cline as counsel for Defendant Mayer, with Leroy Cox appearing for Defendant Lorraine Cox, and Robert Porter for Utah state engineer. en-gineer. Issues of the case were discussed and the court entered its pre-trial order. |
