U.S. District Magistrate Judge David Nuffer agreed with prosecutors who argued Jeremy David Johnson presented a serious flight risk. Prosecutors allege Johnson's company, iWorks, sent software to consumers for a supposedly risk-free trial, but then billed them anyway. Court papers say hundreds of thousands of people and several merchant banks were victimized by Johnson through iWorks and dozens of related shell companies. Prosecutors say iWorks and other Johnson companies mailed consumers CDs that contained information about government grants for personal, business and education expenses. "The fact is that nobody got a cent from using that CD, except (Johnson's) own company/' Utah Assistant Attorney General Brent Ward, told the judge. Johnson pleaded guilty to the charge last week and faces a 20 year prison term if convicted. Johnson was arrested June 11 as he waited in Phoenix for a flight to Costa Rica. Federal agents say Johnson was carry- ing more than $26,000 in cash and a one-way plane ticket. The single criminal charge paralleled a Federal Trade Commission civil action filed in Las Vegas last December. Johnson has denied those allegations as well. In that case, a federal judge issued an injunction freezing Johnson's reported millions of dollars in assets and restricting his ability to make money from Internet ventures. Federal prosecutors said that despite those stringent restrictions, Johnson has been allowed to travel internationally and access large amounts of money, suggesting he lied to investigators and may have hidden bank accounts. "No bond is sufficient," Ward told the judge. That argument gave pause to the judge, who said he didn't believe he could ensure Johnson would show up for future court hearings unless he was detained. But Nuffer said he would consider Johnson's release if the businessman could post a $1 million bond backed by "unencumbered property." Family and friends have identified about $1.3 million in property and more than $500,000 in cash to assist with Johnson's release, his attorney, Nathan Crane, told the judge. Crane said he'll file a motion for bail with the court as soon as he can provide the documentation Nuffer requested. Johnson has also fully cooperated with the FTC's investigation and would have surrendered to authorities in the criminal investigation had he known he was being sought, Crane said. About 30 people showed up to support Johnson at the hearing, many standing along the back wall of Nuffer's small courtroom for nearly three hours. Seventy people also submitted letters of support to the judge, including former Washington County Sheriff Kirk Smith, who called Johnson "a man of his word." "He has been an overwhelming asset in this community assisting others, spending count-: less hours of his personal time, energy and resources," Smith wrote of Johnson, who has flown his personal helicopters to assist law enforcement in search and rescue cases in Washington County. "In all my experiences, Jeremy has conducted himself with the highest of integrity to me and to those who worked around him." Johnson is a wellknown Utah philanthropist who donated generously to charity and to the political campaigns of Utah's current attorney general. He made international headlines in January 2010 when he purchased a plane to fly doctors and other critical supplies to Haiti following a devastating earthquake there.
