Show COURIUPHOLDS DISTRICT LAW Judge LeRoy H. Cox Renders Ren-ders Decision Favorable to City in the Case of Mrs. Annie C. Johnsen The city business district ordinance ordi-nance which was passed last spring, and which was attacked by Mrs. Annie C. Johnsen on the ground that it was invalid, was upheld by District Judge LeRoy H. Cox' in a decision rendered this morning. This action is an outgrowth of an ordinance passed last spring by the St. George city council declaring a business district and ordering all livestock to be removed re-moved from within its boundaries. Mrs. Johnsen failed to comply with the order and was found guilty in the city justice court of violating the ordinance. She appealed to the district court, was again declared de-clared guilty, and defendant then asked for a stay of judgment on the ground that the ordinance was invalid. City Attorney Orval Hafen represented rep-resented the city, while E. J. Pickett Pick-ett was appointed by the court to act for the defendant. The ruling upon the motion and rest of judgment, by Judge LeRoy Le-Roy H. Cox, follows: This case came before the court on October 11, upon a waiver of a jury trial, and upon a stipulation stipu-lation cf fiets entered into in open court in the presence of the defendant and assented to by her. whereupon the ccurt found the defendant guilty of violation of 'section 20 of a city ordinance cre-! cre-! ating a business district in the j city of St. Gecrge. j Said ordinance was duly pawd by the city council and declared passed March 1. 1930.
