If I am rightly infnrr.ied tht! present congress pass ir up as being non-intoxicating; yet our l'tah Legislature interpret-; the law dealing with the subject as meaning that it i-s an intoxicant, at least I draw the inference that they consider it such from the fact that the Legi!ature passed a law prohibiting its use in the -tate and the shipment into dry territory. I contend that if Congress determined de-termined 2.3 per cent beer as being be-ing a non-intoxicant it is K-ga'ly such even tho it contains per cent alcohol, and in sm 1: case it has no more connection with the prohibition law than does the pure crystal wa'ers that How from the heart of the mountain. The prohibition law iin'.s only with such beverages a-i are considered consid-ered or known to be ir.toxicatmg ; why then, should our law givers spend so much time pow-wowing anent ".2 pt r cent beer? Why all this silly prattle over a mere political poli-tical nonentity? If a man should get drunk and no doubt they do on 3.2 per C"i".t beer he would still be legally s.mj er. and quite immune from legal prosecution, and could not. by any process of law be punished for violating the prohibition la-.'
