accomplish their design sand to prevent the assertion of the supremacy zacy of 01 ch il if law in the tha territory lat last fall aall judge sinclair Sir clair attempted to hold a session of lis his court in n this city but soon became convinced that si so complete a control did the church authorities exercise v er his court that he was w as by continuing the session of the court merely lubsen ing their own nefarious plans ahe grand jury duty duly sworn and chang charged d behim b him refused even ei en to find an indictment against a criminal who acknowledged publicly that he ha had bad R first abbot and then cut the throat of a poor deaf dat and dumb boy this because he ivas as acting under instructions instruct ians from the church when he committed the deed the legislature then in in session refused to te furnish the necessary means to defray the expenses elfei sea of the court and the maintenance of prisoners this because they knew that they could thus most effectually put a check upon the proceedings proceed ei ings of the court the judge was w as thus compelled to adjourn the court and the prisoners coit confined fined under his big authority were released by an order of the probate coi rr at this time an wilbrt conflict of opinion between federal officers gave gae encouragement curag coura gement to the mormons cormons in the course i which i they seem bent upon and therefore refused 0 to o take notice of their treason and rebellion judge cradlebaugh fully informed of nany mady cr crimes mes committed in his district determined to hold a session evasion of his Court this spring trusting that by avoiding the greater moral questions ques tiona ions which must sooner or later be ad judi upon pori the federal courts of the territory he would perhaps find embarrassed and Iid thiv arted in his unsuccessful attempt to administer admi mister justice in f his district by the failure of bf the legislature to provide means for the maintenance and security of prisoners judge cradlebaugh Cradle bangh sati sat iCed fied that none had ad been pr provided ovidea in his hia district wisely took ahi pre precaution lon of exercising exercising a right delegated to him and madea made a requisition ion upon gen johnston tor for a small military detachment to keep and maintain prisoners in his hia charge to the grand jury a jury selected by the county court the judge pointedly and emphatically defined his views news and position and in in order to prevent any possible misunderstanding called their attention plainly and particularly to crimes committed in in their midst we now dow find that in in the teeth of positive evidence this jury after a session of two i weeks refuse to find any indictments but j endeavor to create delay in order that they may accomplish the breaking up of the yourt court by a scheme which in in the meanwhile is ia vigorously prosecuted every endeavor i 13 9 being used every exertion made to procure the removal of the troops and thus compel the court to adjourn now to our great regret we find them again sustained and encouraged in their deep laid plots by a federal officer cerr governor cumming differing widely not only with judge cradlebaugh but also with general joan john in regard to the extent of his big control the movements of the military force now in in the territory attempts to interfere directly with the judiciary in the exercise of its legitimate functions by ass suming the control contro I 1 of the military detachment placed with uth certain restrictions under the direction of the V U S marshall marshal by gen johnston ife does this too at the solicitation of the mormons cormons Mor mons who by a cunningly devised memorial appeal to bis big official pride in in iman a manner well calculated to lead him into the grave error into which as we have heretofore here t stai stace edhe he has chastely and unwise unwisely f fal aal aol A judge cradlebaugh however determine I 1 not to be thwarted by such means adjourned the grand jury and sitting as a committing magistrate has himself exposed and made rr ade public the crimes for which the grand jury refused to find indict et and has c learly clearly set forth and made apparent the urgent reasons which induced the opposition on the he part ot of the church to the sessions of the U S district courts and also the means adopted e by them to accomplish their alms aims the effect 0 of this decisive course of judge cradlebaugh is we e have fully laid before our readers in in our coli mrs four of the he church tio ners are now fully committed and are imprisoned the zest lest implicated including all the church leaders lit in that region and several of the jurors ha have e red fled we have hare now reached a most imports t crisis crisis in in the affairs of our territory the judiciary are pov pon erless to act unless they seek leek the assistance of the U S troops and judiciary ven even with this assistance can accomplish but little under the present circumstances they cannot punish offenders or bring criminals to lu stice the majority of this community with mind blind and fanatical zeal in in their religion combine to resist the execution of any law except such as emanate fro from their lo leaders iders before the arrival of the army arm they compelled by force foice and by extreme i violence the obedience of the minority depriving them of all of their rights as american citizens citizen to secure this 0 obedience they did riot not hesitate to commit even publicly the most atrocious and horrible crimes now 1 ow they unite even ev en more firmly to resist the punishment of the perpetrators of these crimes in their purpose to sustain themselves N vv ith the assistance of the army until some new pro provision ision is made the judiciary have hav e found themselves most unexpectedly oppose opposed dby by the governor in in a manner calculated rather to strengthen the mormon fanatics in their designs jt it is is clear to our mind that the judges have hav e in this matter taken the proper and only course but still we do not find fault with go gov merely for dif differing fiering in in opinion 0 n with them in in regard to the extent of his authority or the construction to be placed u upon pon h his is 11 instructions we nevertheless do believe e that he should have sent his bis protest to the proper department at washington quietly and unostentatiously he would M no not t then have sustained murderers and assassins in in their attempts to defeat the ends of justice and would i not have allied himself with the leaders of the mormon church there is is no remedy for the evils of hibb which lie he complains in in his protest except at Was washington baslington Lington why
