Be it enacted by (he Senate and House of Keprescntaiives of , the United States of America in Congress Con-gress assembled, That the jurisdiction juris-diction of the Court of i Claims to inquire into and finally, adjudicate claims If or property of" citizens of the United States taken and dis-trbyed dis-trbyed i'hbteby;bxtended.so.as -to include claims for property of residents resi-dents as well aa citizens of , the Tni ted States taken or destroyed by Indians belonging to any band, tribe, or nation in amity with the United States, or with whom the United States had treaty relations, or failed to exercise due diligence in protecting such residents' or citizens, such property having been taken or destroyed without just cause or provocation on the part of the owner "or agent in charge, and not returned or paid for, also, so as to include claims for services rendered or property furnished by residents or citizens in guarding or defending against depredations by such Indians in cases where the Government of the' United States has refused or neglected to furnish such protection when it might, by the exercise of reaaon-able reaaon-able diligence, have done so. i ' ! Sec. 2. That no claim accruing prior to July first, eighteen hundred hund-red and Bixty-five, or- after March third, eighteen hundred and ninety-one, shall be considered by tho court, but all claims, provided for in the foregoing section. which accrued ac-crued during said time shall be presented to the court by petition, as provided by law, within' f five years after the passage of tliifi Act or bo forever barred. |
