Bacon, Ba-con, State Engineer of the State of the .State - of Utah, and to Harry Spears, Greeting: You and each of you will please take notice that the appellant in the above entitled, action hereby appeals to" the District Court of the Fourth Judicial District of the State of Utah, in and for Duchesne County, from a certain decision of the said I George M. Bacon, as State Engineer of the State of Utah, rendered 011 March 11, 1927. in the matter of water .filing No. 34 GC of Francis M. Ross, Charles W. Robison, 'Samuel Solomonson. Byron Thompson, George Sumers, and Harry Spears, which decision denied issuance of water certificate to the appellant I under said filing unless quit-claim or assignment by the said Harry Spears t be duly shown. Appellant will pray for a decree of said court decreeing that the said Harry" -Spears has no vright title or interest in or to the. above described water filing, and for j an order of said court directing the said State Engineer to issue water j certificate to this appellant under I said filing forthwith.
