Show Jury Awards for Plaintiff In Recent Moab Court Case A three-day civil case in Seventh Judicial District Court was concluded Thursday, April Ap-ril 29, with the jury awarding $12,000 to the plaintiffs, James E. Allred and Son. The plaintiffs had brought suit against Lee and Janet Howland on an oral construction construc-tion contract encompassing the United Campgrounds at Elgin, Ut., claiming $12,378 was due them. The Howlands answered, denying that they owed Allred and Son any sum whatsoever on account of said construction work and materials furnished. Howlands also filed a counterclaim counter-claim in which they alleged that Allred and Son did the work in a faulty manner, in that the electrical work, plumbing and other work was not constructed according to plan, and was defected. Howlands also claimed that the cost of repairing this defective work would amount to about $19,000, and further claimed that although the contract provided that the work would be completed within 60 days, it was not finished until a substantial time after 60 days. Because of this, Howlands contended they lost many customers and stated that they were damaged in the sum of $6,000. The counterclaim totaled in excess of $25,000. Judge Edward Sheya direc-. ted the jury to bring in a verdict in favor of Allred and Son and against Howlands in the sum of $12,000. However, the court submitted the counterclaim to the jury to determine whether or not any cause of action existed against James E. Allred and Son. The jury, after deliberating about 2 hours, brought in a verdict in favor of Allred and Son and against the Howlands on the counterclaim, no cause of action. |
