Show City Court News... On Sept. 28 the case of City vs. Larry and Kathy Hixon came up for trial in City Court. They had been charged with maintaining a nuisance and with keeping more than two dogs at a one-family dwelling. Following the close of evidence evi-dence Mr. Hixon's attorney made a motion that the charges charg-es against him be dismissed, on the basis that he did not own any of the dogs involved. This motion was granted. The court found Kathy Hixon Hi-xon guilty of the charge of maintaining a nuisance. She was sentenced to serve 10 days in jail, which was suspended suspen-ded on the condition that she get rid of all the dogs by Oct. 5 at 6 p.m. The animal control officer was ordered to follow through to see that the court order was complied with. In the case of the State vs. Jerry Day, Jr., on a charge of criminal trespass, the defendant defen-dant failed to appear for trial and bail of $50 was forfeited. The case was then closed. There was a jury trial held in the case of the State vs. Robert Lee Boot, who was charged with speeding 75 in a 55 per mile zone. Following the trial the jury found the defendant guilty of speeding 63 miles in a 55 mile zone, or 8 miles over the speed limit. A $15 fine was imposed. On Oct. 4, Julie Horner and Mark Wittkoph appeared on charges of possessing a controlled con-trolled substance. Both defendants defen-dants entered pleas of guilty and each was sentenced to pay a $75 fine and serve 15 days in jail, with the jail sentence suspended on payment pay-ment of the fine. The same day Randy Born-schein Born-schein appeared with counsel for arraignment on a charge of burglary. He was given a copy of the complaint, which was read in open court, and was advised of the nature of the charge and the penalty provided provi-ded therefor. He was also advised that the matter was triable in District Court and that he was entitled to a preliminary hearing in City Court, and on advise of counsel, coun-sel, he waived preliminary hearing and the court ordered him to appear before the District Court on Oct. 11 at 10 a.m. Pursuant to the recommendation recom-mendation of the county attorney, at-torney, he was released on his own recognizance. |
