Show WILLIAMS ACQUITTED OF manslaughter FOR SLAYING MOCK JURY RETURN VERDICT OF ACQUITTAL AFTER deliberating SHORT TIME CHARGES STILL PENDING AGAINST AND ALLEGED CO conspirators L E tudy williams 23 charged with manslaughter in connection with the death of robert W mock who was fatally beaten outside a dance hall at cisco on the morning of january 17 last was found not guilty by a district court jury at 9 15 p m monday evening three hours after receiving the case the jury deliberated about an hour on the matter most of the three hours being consumed in eating supper and waiting for the court to reconvene three ballots were taisea b the jurors before all agreed on an acquittal the introduction of evidence in the case started thursday afternoon immediately after the following jury had been sworn in howard hastings reed somerville R J fletcher sam hudson charles medlen stewart somerville madrid johnson and jesse holyoak knox patterson associate counsel for the state made the opening address for the prosecution dr I 1 W alien was the first witness testifying as to the nature of the wound on mocks head other states witnesses were virginia gruver walter gilbert genevieve Genev leve agnes crowton and elsie crispin who gave evidence tending to show that williams serefin and john Berran cua had conspired to beat up mock on the evening of the dance F C martin a grand junction undertaker testified regarding the wound on mocks head at the conclusion of the states evidence the attorneys for the defense burgess and adams and C A robertson moved to strike certain testimony and for a directed verdict of acquittal quit tal which was resisted by district attorney FW keller and mr patterson the motion was denied by judge deworth woolley attorney adams made the opening statement to the jury for the defense in which he said the defense would introduce evidence to the effect that mock was quarrelsome on the night of the homicide and was the aggressor in the tight which ended fatally for him the defense witnesses were roscoe C hallett john Berran cua guy miller walter T thirsk W B capansky pat P dyer mrs robert armstrong john A johnston and the defendant L E williams their testimony in the main tended to bear out the opening statement of the defense attorneys williams the defendant was on the stand for several hours and in spite of a severe grilling on cross examination made a good witness he denied any conspiracy between him and his two associates and Berran cua to beat up mock he states that the three went outside the dance hall with elsie crispin to have a drink and that mock called williams a vile name and the two pulled their coats williams said he struck mock twice and that the latter fell to the ground the state called walter gilbert ira mock and sheriff J B as rebuttal witnesses one of the principal witnesses tor the state was genevieve Genev leve agnes crowton an eyewitness eye witness to the homicide she testified that she had been living with serefin Oler aln and that he had a pair of brass knuckles in his pocket en the night of the tight and told her he and friends were going to get mock she stated that after williams knocked mock down struck the prostrate man several times with the knuckles she further testified that Ol erain williams Berran cua and several others held a conference after the killing and decided that she should not testify at the inquest and trial she wanted to testify she said but they would not let her other evidence introduced by the state tended to show that the defendant and his companions had tried to conceal the identity of the crowton woman and had insisted that no other woman besides miss crispin was present at the homicide walter gilbert gave important evidence for the state when he said that Berran cua had told him that he wil bams and were going to get mock he said that after the homicide he told Berran cua that the three had made good on their threats and that Berran cua then related the whole circumstance of the tight the witness was not permitted however to relate what Berran cua said the introduction of evidence was completed about 3 0 clock monday afternoon and the arguments of counsel were then given attorney patterson made the first argument for the state he was followed by attorney robertson for the defense attorneys adams and burgess of defense counsel then spoke and district attorney keller made the concluding address the court read his instructions to the jury and at 6 20 p m the jurors retired to deliberate on the case soon afterward they were taken out tor supper and at 8 45 reported that they had reached a verdict it was about 9 15 when court reconvened R J fietcher who had been chosen as foreman of the jury read the verdict which acquitted williams of the charge the court thereupon discharged the jury and the defendant charges of manslaughter against Berran cua and Oler aln who are charged with in connection with the homicide are still pending ber was arrested last week and held in the county jail for several days after the verdict was returned in the williams case he was released without bond on his promise to return whenever requested to do so A warrant I 1 for the arrest of has been issued but so far the sheriff has been unable to locate him he was reported to have been at eureka utah last week but officers at that place cannot find him Is known to have been in telephonic communication with friends in grand county and undoubtedly knows that he Is wanted here officers state Berran cua and are both basques many civil matters heard
