B. Diehl yesterday afternoon. In default of $7000 bail he was remanded to the county Jail. During the afternoon the attorneys for both the State and Dr. Payne reviewed re-viewed the testimony and argued the 'case, after which it was given to Judge Diehl for his decision. - The latter believed be-lieved that there was sufficient evidence to warrant the detention of-Xr. Payne, and accordingly bound him over. He said that the defendant's story was apparently ap-parently Very rriuchin conflict with the weight of evidence, and was Incongruous Incongru-ous In several vital particulars. He could not believe it possible for a womaft who was unable to speak, to remove re-move her coat, hat and overshores and lie down on a sofa and die Immediately. He characterized Dr. Payne's statements state-ments as being remarkable and beyond belief In many particulars, and stated that the contentions of the prosecution had not been successfully-met. |
