ASHCRAFT City Recorder SEAL w l o j LEGUL HOT ICE ORDINANCE NO. 29 AN ORDINANCE TO REGULATE THE INSPECTION, IN-SPECTION, GRADING, REGRADING AND PLACARDING PLA-CARDING OF EATING AND DRINKING ESTABLISHMENTS; ESTAB-LISHMENTS; THE ISSUING, SUSPENSION, AND REVOCATION OF PERMITS FOR THE OPERATION OP-ERATION OF SUCH ESTABLISHMENTS; THE ENFORCEMENT OF THIS. ORDINANCE, AND THE FIXING OF PENALTIES; AND PROHIBITING PROHIBIT-ING THE SALE OF ADULTERATED, MIS-BRANDED, MIS-BRANDED, OR UNWHOLESOME FOOD AND DRINK. r TTnrr BE IT ORDAINED BY THE CITY COUNCIL OF SPRINGVILLE, UTAH: Section 1. The inspection, grading, regraclmg, and placarding of eating and drinking establishments within the City of Springville, Utah, or its police jurisdiction; the issuing, suspension, and revocation of permits for the operation of such establishments; the sale of adulterated, misbranded, or unwholesome food and drink; the enforcement of this Ordinance and the fixing of penalties shall be regulated m accordance ac-cordance with the terms of the unabridged form of the 1943 edition of the U. S. Public Health Service Ordinance Regulating Eating and Drinking Establishments, Estab-lishments, a certified copy of which shall be on file in the office of the City Clerk: provided, that the words, "City of Springville," in said Public Health Service Ordinance shall be understood to refer 'to the city of Springville, Utah : provided further, that in said Ordinance all parenthesis signs, which enclose words referring to grading, shall be understood to be deleted: provided -further, that Sections 7, 12 and 13 of said Public Health Service Ordinance shall.be replaced, respectively, by Sections 2, 3, and 4, below: provided further, that in Section 2 of said Ordinance, itinerant restaraunts shall also be required to secure a permit. Section 2. From and after twelve (12) months from the date on which this Ordinance takes effect, no restaurants shall be operated within the City of Springville, Utah, or its police jurisdiction, except Grade A, Grade B, or approved itinerant restaurants : provided, that when any restaurant fails to qualify, the Health Officer is authorized to suspend the permit per-mit or in lieu thereof, to degrade the restaurant and permit its operation during a temporary period of not exceeding thirty (30) days. Section 3. Any person, firm, or corporation violating vio-lating any provisions of this Ordinance shall upon conviction be punished by a. fine in any sum not exceeding $299.00, or be imprisoned in the City .or County Jail for a period of not longer than six (6) months, or by both fine and imprisonment. Section 4. All Ordinances and parts of Ordinances in conflict with this Ordinance are hereby repealed; that in the opinion of the City Council of Springville, a Municipal Corporation, it is necessary to the health, safety, and welfare of said city and the inhabitants thereof, that this Ordinance shall become effective immediately upon its passage and publication.
