Show Ex-Dry Agent to ' Pay Penalty For ' Rape Conviction Re-Sentenced To Serve Not Less Than 5 Years For Crime; Appeal of Decision Is Denied By Supreme Court. 1 Loyal Christensen, former federal prohibition agent, was committed to the state penitentiary Friday afternoon by Sheriff J. D. Boyd to begin serving a sentence of not less than five years. He was re-sentenced by Judge George W. Worthen -Frnlay-morning in the Fourth district court after the supreme su-preme court denied his appeal, and affirmed the sentence of the lower court. Christensen was present in court this morning with his attorney, Vere McCarthy, and his bondsman, having been brought here on a remittitur issued by the supreme court. Attracted Statewide Attention The trial of Christensen here attracted statewide attention atten-tion because of his activities as a prohibition agent. He was found guilty of rape by a jury in the Fourth district court, November 26, 1927, and was sentenced by Judge Martin M. Larson on December 23 to serve a term of not less than five years in the. state prison. Christensen appealed the case and it was taken before the supreme court, May 12, 1928. The decision affirming the sentence of Judge Larson was concurred in by all of the members mem-bers of the court, and was written by Judge Straup. |
