Issue is taken by Bingham city officials with Richard Hartley, county attorney, on the matter of the responsibility for the prevention of spring floods in the case of the Mystic Shrine dump and other obstructions through Markham gulch. The point is, according to the city officials, of-ficials, that the town has jurisdiction as to the befouling of culinery waters outside the corporate limits, but not to obstructions such as the one in controversy. contro-versy. The county has been maintaining the creeks and taking care of them at other points in Bingham, and city officials cannot can-not understand why an exception is being be-ing made in the case of Markham gulch. The letter of N. A. Robertson, assistant county attorney, to David W. George, town attorney of Bingham, says in part: After careful examination of the situation sit-uation and full consideration of the matter, I advised the board of county coun-ty commissioners that the matter is one within the power and jurisdiction of the Bingham town body to remedy. Fear Loss of jLife. There is no doubt that the dump you speak of is a nuisance, or will become one in the event of a flood, and this will be aggravated by the fact that your town board has permitted per-mitted the Bingham-Butte dump co be built over the main canyon opposite op-posite the school house, and that the weight Of this dump, as we have, been informed, caved in the flume to such 1 an extent that if the debris from the Mystic Shrine dump should come down in a flood it would probably choke up the flume and cause considerable damage and perhaps loss of life. In discussing the matter, Bingham city officials yesterday said: There is some unfavorable comment on the opinion of the county attorney handed to the county commissioners In relation to the responsibility for the condition of the Markham creek in the county district outside of the corporate cor-porate limits of Bingham and reference refer-ence being made to conditions within the town. From information obtained it Is evident evi-dent that the town authorities are giying a great deal of attention to the Bingham, creek within the town limits. - The 'annual expenditure for this purpose is about $5000. Says Flume Is Good. If the county authorities maintain and take care of the other portion of the creek it is not clear why Markham Mark-ham creek should be neglected. It is evident that if the Mystic Shrine dump be carried down the gulch by high water it will not have a chance to reach the Montana & Bingham Bing-ham flume, as it will already have done its damage in the county dis- buildings in that vicinity. Evidently the county attorney has been misinformed as to the conditions condi-tions of the flunfe in main Bingham, as it is in a condition to carry any flood water which may reach thaV point. |
