The Frank Phil-brook Phil-brook murder trial was virtually completed com-pleted toilny when the state had completed com-pleted its introduction of evidence ut 1:40 o'clock this afternoon. At that time Soren X. Uhristonson, attorney for the defendant, announced that he would make a lengthy motion for' dismissal on the grounds of lack of evidence, so Judge X. J. Harris decided to adjourn court until 10 o'clock tomorrow morning. morn-ing. If the proposed motion of the defendant's de-fendant's attorney is granted, the jury .will be instructed to return a directed lr verdict. Attorney Christ ensen has not Jr outlined what action he will take regarding re-garding the introduction of evidence should the motion be overruled bv the court. At the conculsion of today's session ses-sion Judge Harris requested the attorneys attor-neys to present whatever instruetious to the jury that they misht have in . mind. Both sides announced that their proposed instructions would be brief. The state introduced five new witnesses wit-nesses today and recalled three of yesterday's yes-terday's witnesses for further examination. examina-tion. The principal witnesses today were Herman Harms, state chemist, and Dr. A. A. Robinson, county physician. Both made investigations regarding the contents of Patrick Quigley'a intestines and other organs, with a view to ascertaining ascer-taining the presence of poison, y St ate Chemist Harms testified that he found nnt more than one-seventh of one grain of morphine in that portion of the intestinal content analyzed. Computing from the standpoint of' how much of the drug had been absorbed, he said that the amount taken might have been a medicinal dope. Dr. Robinson Rob-inson testified that from his autopsy he was not prepared to say whether' the aged miner 's death resulted from poison poi-son or some other cause. Other witnesses for the state were Fernaldo Ellsworth, who told of Phil-brook's Phil-brook's having engaged a room at his place for James O'Brien on the night following the alleged murder; Sheriff T. A. DeVine, who said the defendant denied having carried Quigley 's body out of the rooming house, and Alfred "Dawson, son of Mrs. Fannie Dawson. Young Dawson said Philbrook told him to keep his mouth shut when he started talking about the Quiglev affair. When recalled to the stand after testifying tes-tifying yesterday, J. L. Hobson, chief deputy in the sheriff's office, said he had been unable to locate Rov Stevens, a witness for the state. Stevens was among the suspects arrested in connec-. connec-. Hon with the death of the miner. Mrs. Dawson and Detective R. H. Wootton were recalled to 'the stand for further auestioning.
