Special to The Tribune OGDEN July 18 Legal rtepe to force the payment by the "Weber conn ty commm.sslonerB of his claim for $2501 for his part in the Joseph Henry Martin trial -were taien by Theodore Kytka the San Francisco handwriting expert today when ho filed a complaint bringing suit in the Second district court Commissioners Moroni SkeeD John T Bybee and William C Hunter are named aa the defendants At a recent meeting of the board the commissioners turned down the Kytka claim on the grounds that they are not authorized under the state law to ex pend public funds for expert testimony The Ban Francisco man represents m his complaint that Martin was arrested on December 4 1913 for the assault upon Detective David Edwards and that on December 28 of the same year he was employed by County Attorney David Jensen and D strict Attorney John C Davis to prepare photographs and charts to be used m the prosecution of the blackmailer According to the agreement, as al leged in the compla nt Kvtka was to receive $25 per day for all laboratory work done m San Francisco and $o0 per day for such time he was required to spend in Ogden as a witness for the I state In add tion to th s all necessary expenses incurred by his connection with the case were to be paid and also he was to be reimbursed for the cost of 1 materials The total amount, as shown bv the cla m presented ou March 1 1914 was $2501 H H Henderson law partner of D s lr ct Attorney Dav s is named as Kytka s attorney in the action. |
