Show QUESTION OF ROAD'S . LIABILITY UNIQUE An Interesting legal point, and one which has never been settled finally, Is involved in a case now under the advisement ad-visement of United States District Judge John A. Marshall between tho United States and the Union Pacific Railroad company. It involves the settlement of a claim by the postal department for approximately ap-proximately 512,000 worth of registered mall which was burned up in a Nevada wreck some time ago. Counsel for the railroad argues that it merely hauls the mail, and that It Is government gov-ernment property while cn route, and that the road is not liable for Its loss In such a case. Tho car containing the mail was burned following the wreck. As similar cases arc now pending in other district courts In the country, and as no decision on the case has yet been rendered, the findings of Judge Marshall ore awaited with Interest by the legal fraternity. |
