V. l)a.is, as a taxpayer, tax-payer, brought" suit in the Third district dis-trict court yesterday against t lie city of Murray, asking that the bond issue be set aside. Tho complaint challenges the right of the mayor and commissioner to call the olcctipn, ou the ground that they hold their positions illegally, Murray being a citv of Jess than 5000 population and therefore not a city of the second class and no! subject to a commission form of government. Jt charges that after the election had been called Mayor George A. lluschcr and Commissioners Gottlieb Berber and G. II. Watts issued is-sued an oflicial resolution in pamphlet form to the people of Murray, setting forth misleading facts and misrepresenting misrepre-senting the issue generally. But for this oflicial resolution, it 'is dcclarod.. the bond issue would have been voted down. I he mayor and commissioners arc charged with having proceeded with the. utmost carelessness and disregard of tho rights of citizens in putting through the bond issue.
