Show CONSTITUTIONAL AMENDMENT A JOINT RESOLUTION PROPOSING PROPOSING PROPOSING PRO PRO- POSING TO AMEND ARTICLE ARTICLE ARTI ARTl- CLE XIII SECTION 2 OF THE CONSTITUTION 0 OF F T THE H E ESTATE STATE OF UTAH RELATING TO TANGIBLE PROPERTIES EXEMPT FROM TAXATION Be it resolved cd by the Legislature Legislature Legis Legis- lature of the State of Utah two-thirds two of all members elected elected elect elect- ed ad to W each h of or the two houses voting in ip favor thereof Section 1 It is proposed to amend Article XIII Section 2 of the tho constitution of or the State of Ut Utah h to read as follows All tangible property in the state stat not exempt under the laws of the United States the State of oC Utah or under this constitution shall shan be taxed in proportion to its value to be ascertained as provided by law The property of the state counties counties coun coun- ties tics cities towns school districts districts districts dis dis- dis- dis municipal corporations and public libraries lots with the buildings thereon used e exclusively ex cx- elusively for either cither religious f worship or charitable purposes and places of burial not held or used for private or corporate benc benefit it shall be exempt from taxation Water Vater rights ditches canals reservoirs power plants pumping plants transmission lines pipes pines and flumes owned and used by individuals or corporations corporations corporations cor cor- for or irrigating lands within the state te owned by such individuals or corporations or orthe orthe orthe the individual members thereof shall not be separately taxed as Ion long as they shall be own owned omed d and used exclusively for or such pur pur- poses Power plants power transmission lines linos and other oIlier property us ld for or generating del delivering erin electrical power a portion of or which is used for lor furnishing power for pumping water for irrigation purposes on lands in the State Stale of ot Utah may maybe be exempted from rom taxation to the extent that such property is used d for such purposes These exemptions shall accrue to the benefit of the users of water BO so pumped under such regulations regula regula- lions Hons as the legislature ma may prescribe The rite taxes of the indigent indi gent ent poor may nay be remitted or abated at such tuch times and nd in such manner as may be provided by law The le legislature may provide pro pro- ide vide for the exemption from taxation of or homes homesteads and personal property properly not to exceed in value alue for homes and homesteads and all household furnishings furniture and equipment used exclusively by the owner thereof at his place of abode in maintaining a home for himself and family Property not to exceed 3 3 in value alue owned by br disabled persons who served jn m any war warin warin warm in m the military p service of the United States or of the State of Utah and by the unmarried widows and minor orphans of such disabled persons or 01 of persons perSons persons per per- sons who while serving in the tile military service ice of or the United States or the State of Utah were killed in action or died as asa asa a n result of such service may be exempted as ns the legislature may provide The legislature shall provide by law for an annual tax buffi- buffi dent with other sources of revenue revenueS to dc defray rn the estimated ordinary expenses of the State for each fiscal year For the purpose of paying the state debt if an any P there be the legislature legis legislature legis- legis lature shall 1 provide ro for levying a 3 tax annually sufficient to pay the annual interest and to pay the principal of such debt within within within with with- in twenty years from the final passage of the tho law creating the debt Section 2 The secretary of state is directed to submit this proposed amendment to the electors electors elec elec- tors of tho the State of Utah in the next general election in the manner provided by Jaw Section 3 If adopted b by the electors of oC this state stale this amendment shall take effect tho the first da day of January Januar 1961 I LA LAMONT F.
