Show BIG FEE SUITS ARE FILED I Government Brings Actions Against H G McMillan and D C Dunbar to Recover 5468249 Three suits were filed in the United States court yesterday afternoon by United States Attorney C O Whlttc moro on bclialf of the Government one case against Henry G McMillan a second against John J Daly and Morris I R Evans and a third against David C Dunbar Frank W Jennings Alfred Y McCuno and Robert C Chambers The suits are to recover several large amounts of money alleged to be due I the Government from Messrs McMil Ian and Dunbar formerly clerics of the United States court during Territorial days and their bondsmen In the case against Mr McMillan Judgment for 52SOS110 with Interest Is asked for I judgment against Mr McMillans bondsmen Messrs Daly and Evans for I 10000 with interest the amount of the bond IP I asked In the second caseIn case-In the third case that taII1At 1 Messrs Dunbar Jennings McCune and Chambers Cham-bers Judgment Is asked In the sum of 1570109 with Interest It Is alleged that the amounts due comprise money received by Messrs McMillan and Dun bar while acting as clerks In excess of their salaries and office expenses The total amounts to S516S219 The cases arose out of the system generally in vogue In Territorial days when It was the custom for the clerks to deduct their salaries and expenses from the fe4s received by tho office In United States criminal cases retaining for themselves the fees received from civil cases In the Territorial United States courts Two AttorneyGenerals of the United States have ruled that the clerics were entitled to this money Senator Rawlins recently re-cently Introduced a bill relieving from liability I all former clerks who might be held responsible for this money The bill passed both Houses unanimously unani-mously but when It was learned that the AttorneyGeneral had recommended I tho vetoing of the bill It was withdrawn with-drawn AttorneyGeneral Grlggs stated at tho time that the bill was too sweeping sweep-Ing and wanted the bill so modified that It would apply only to accounts now pending The bill will probably be Introduced In Its modified form next December A Judgment for 5109836 against Mr McMillan In a similar case was rendered ren-dered in tho United States court here and paid by Mr McMillan on October 1t 1897 Mr Dunbar stated last night that both Mr McMillan and himself were In receipt of letters under date of June 18th over the personal signature ofl AttorneyGeneral Grlggs stating that he had ordered all such suits withheld pending legislation Mr Dunbar also stated that during Territorial days no returns from civil business In the United States courts here were demanded de-manded or accepted at Washington Nq compensation for deputy clerk or janitor Jani-tor hire was allowed and the clerks of the court were required to pay for their own stationery typewriting ando and-o fixtures out of the fees received from civil business When all this Is taken Into consideration Mr Dunbar says It will bo found that the balance is tho other way and so as a matter of fact he now has a claim for 53000 pending at Washington United States Attorney Whlttemore states that In bringing the suits he Is acting under direct Instructions from the AttorneyGeneral and the Solicitor of tho Treasury Tho Instructions which wero received by Mr Whltte more Juno 20th ordered him to bring the suits at onco and report immediately immediate-ly l to the AttorneyGeneral taking no further steps until further advised It Is thought probable that the cases will not be brought to trial until tho bill referred to Is presented to Congress again or dropped |
