Fnrmlngton Dec 30NIck llay worlh was aruigned before City Justice Jus-tice Ezra F Richards at 11 oclock this morning to plead to a complaint charging him with having entered the Farmers Union store at layton on I the night of March 28 1SOO and committing com-mitting the crime of murder by shooting shoot-ing Thomas Sandall to death The complaint was sworn to by J P Kill son superintendent of the Farmers Union store The proceedings before Justice Richards Rich-ards were brief When the Justice called the case of the State of Utah VH Nick llayworlh L U Reavls and James Stephens he Inquired If the defendants de-fendants were In court and Sheriff Abbott Ab-bott replied that defendant Nick llay worth was present The prisoner stood up at the request of the Justice while the complaint was being read and a nervous twitching of tho muscles of his face and a continuous movement of his hands gave evidence of extreme though suppressed excitement In answer to 0 query from the court he said Yes sir my name Is Nick llayworlh and then he stood erect with his hands crossed in front of him and wllh downcast eyes while tho reading of the complaint was finished This done Justice Richards asked Are you ready now to plead to the complaint 7 V ATTORNEY LIPPMAN Ere the prisoner had time to make n I reply Attorney Joseph Lippman stepped forward and said Before defendant de-fendant pleads to that complaint 1 desire de-sire to make a statement Some friends of the defendant called upon Powers Siraup ts Lippman and employed us to appear here In behalf of Air Flay worth In response to that I came excitement around the county Jail last night caused by th2 queer actions of the prisoner Hay worth Jailer Thomas Abbott had given tho three prisoners their supper and gone home and there was no one around the courthouse or Jail yard when at about S oclock hideous noises were heard by neighbors emanating from the jai Sheriff Abbott was summoned sum-moned and found J lay worth almost prostrated with fright The prisoner who Is Incarcerated In the same Inclo sure with two of the Kaysvllle burglars bur-glars declared to the Sheriff that there was f conspiracy to kill him and that ho had been locked up with the other men that they might mUller him He demanded protection and asked that a guard bo slalloned at the Jail Th < none n-one of the other prisoners Frank Armstrong Arm-strong a onearmed man called upon the Sheriff to protect him from Hay worth whom he regarded as a dangerous dan-gerous man Why said Armstrong that fellow might have me eaten up before morning The idea of his
