Show TRUSTEES SALE WHERKAS LEONARD 8. Osgood and Rama L. Osgood, his wife, on the firm day of December, 191, made, executed and delivered to Emil J, Kaddatz their certain promissory note for ihe principal earn of three thousand three hundred and ixteen aO-100 dollar, payable to the order of said Emil J. Raddatz, ninety day after date thereof, with interest ther-on ther-on at the ratje of one (1) per cent per month nuttl paid, and Whereas, To seenre the payment of said note the aaid Leonard S. Osgood aud Rum a L. Onood on said day made, executed and delivered to H. McDowall as trustee for the said Emil J. Rad-datz Rad-datz their certain trust deed in writing of that date, which aid trnat deed was duly certified, acknowledged and recorded in the race of the County Recorder of Tooele Comity, Utah Territory, Terri-tory, on the third dny of December, 1891, and thereby conveyed to aaid McDowall the following mining property, tow.L: An undivided three-fourths three-fourths () interest of, in and to the "No-U-Don't" Lode, mining claim, citi.ate an the Rash Valley Alining District in the said Connty of Tooele, designated as U. S. Survey, lot Xo. 83, and more particularly described in arid by said trust deed. Also an undivided three-fourths () inter-eft inter-eft of, in and to the Laura Lode, mining claim, ituate in the said Rush Valley Mining District, Connty of Tooele, Utah, more particularly described de-scribed m and by the location certincate thereof recorded $n Book F, at ps?e 182 of the records in the office of the District Recorder of said Rath Valley Mining District and in and by Slid trust deed. Also one (1) upright boiler, engine and blower now upon said 'No-U-Don't mining claim, and Whereas, It Is provided, in said truat deel that I In case default bt made in the payment of said promissory note, that the said trustee might proceed pro-ceed to sell, and sell ani dispone of said premises or any part thereof, aud ati right, title, benefit and eqnity of retlemotion of the said Leonard S. Oscood and RniU'i L. Oegood, their heirs and assigns therein eilher in mass, or separate par-i par-i eels at public auc ion on said premises or any part thereof, for the highest and best price the same will bring in cah, twenty days previous notice of such sale having been given by pnb-I pnb-I lication in any newspaper at that time pub-I pub-I lished in the connty of !Salt Lake, Utah Terri-i Terri-i tory, and out of the proceeds of such sale, first I to pay the cost of advertising, selling and con- 1 veying said preraues, including a reasonable commission to the trustee for his ervices and a rea-or.able attorney's fee and all other expenses of this trnst. Secondly, to pay to the holder of said promissory promis-sory note bU-h sums as he may have paid for taxes or ass-eesment on said premises, or to extinguish ex-tinguish any outstanding title or liens thereon. Thirjly, to pay the full amount ot said promissory promis-sory nots together with interest thereon, and, whereas, the sold Leonard 8. Osgood and Emma L.
