Show Trustee's Sale. WHEREAS, LEONARD s. OSOOOD AND Sana L. Osgood his wife, on the fir-t day of December, 1S91, made, executed and delivered to Kmil J. Raddatz their reitain promissory note for the principal sum of threes thousand threa hundred and sixteen 80-106 dollars, payable to tln order of the said Kmil J. Hud latz, uiuety days I after date thereof, with inteiest tin n on lit the rate of one (li per cent per month until paid, ami Where a?, to secure tho payment of said note tho said Leonards. Osgood and Hnnia L. Osgood on said day madi, executed and delivered to S. Mellow Me-llow all as tr;n-tee for the suid Kmil J. KadeiatA their certain trust deed in writing of thiit date, which said trust deed was duly certified, ackuowl-eilgeel ackuowl-eilgeel and recorded in tho ollice of the t ounty Recorder Re-corder of Tooele I 'ounty, Utah Territory, on tho third day of December. 1W1, and therehy convoyed to said McDowall tlie following mining pioperty, to wit.: An undivided three fourths t) interest of, in and to the "No-U-Don't" Lode, mining claim, situate in the Kush Valley Mining Distrit-t in the said County of Tooele, designated as U. S. Survey, lot No. H, and more particularly described de-scribed in and by said trust deed. Also an undivided undi-vided three fourths (3ii) interest of, in and to t!ia Laura Lode, mining claim, situate in the said Rush Valley Mining District, County of Tooele, Utah, more particularly described in and by thu location certificate thereof recorded in Book K, at pne isg of the re-cords in tho oftice of tho Dis-trii Dis-trii t Recorder of said Rush Valley Mining District Dis-trict and in and by said trust deed. Also one (1) upright boiler, engine snd blower now upon said "ISo-r Don't" mining claim, and Whereas, it is provided, in said trust deed that in case default be made in the payment of suid promissory note, that the said trustee might proceed pro-ceed to sell, and sell und dispose of said premises or any part thereof, and all right, title, hem-tit and equity of redemption of the said Leonard 8. Osgood and Ruma L. Osgood, their heirs and assigns therein either in mass, or separate parcels par-cels at public auction on said premises or any part thereof , lor tho highest and best price tho same will bring in cash, twenty days previous notice of such sale having been given by publication pub-lication in any new.-pc;ier ax that tiiua published in the county of Salt, Lake, Utah Territory, and out of tho proceeds of such sale, first to pay the cost, of advertising, belling ami conveying said premises, including a reasonable commission, to the trustee for his services and a reasonable attorney's fee and all other expense of this trust. Secondly, to pay to the holder of said promissory promis-sory note such sums as he may have paid lor taxos or assessment on said premises, or to extinguish ex-tinguish auy outstanding title or liens thereon. Thirdly, to pay the full amount of said promissory prom-issory note together with interest thereon ; and, whereas, the said Leonard 8. Osgood und Puma L. Osgood have rot paid said promissory note, nor any part thereof, and tho same is past due and poyaoles Now, therefore, in consideration of the premises, and of the power veste 1 iu me by said Trust Deeel anu by request of the legal holder of said promissory note, 1 will, on the (27; hi Twenty-Seventh day of April, IStrJ, at Teu o'clock A.
