About a year ago two carloads of ore were shipped by J. F. Matthews of Monterey, Mex., to E. II. Chichester, through the port of Eagle Pass, where the collector of customs held it for non-payment of $30 per ton duty on all ores classified as silver or lead. The consignee held that the ore should be classified as silver and admitted admit-ted duty free. He appealed from the decis- ion of the collector to the Lnitcd states board of appraisers in New York as to the rate of clasMfk-ation and the assessment of duty. The board decided in favor of Chichester. Chic-hester.
