Show SUMMONS. In the district court of the third Judicial district dis-trict of Utah territory, County of Salt Lake. Olive Avery, Plaintiff, vs. Sylvester Avery, Defendant. The people of the Territory of Utah send greeting to Sylvester Avery, defendant. 'OU ARE HEREBY REQUIRED TO AP-pear AP-pear in an act on brought against you by the above plaintiff In the district court of the third judicial district of the territory of Utah, and to answer the complaint Sled therein there-in within ten days texciustve of the day of service) ser-vice) after the servlve on you of this summons if served within this county ; or. If served out of this county, but in this district, within twenty days; otherwise within forty davs or Judgment by default will be taken against you, recording to the prayer of said complaint. The said action is brought to hav a dcro of this court dissolving the bonds of matrimony matri-mony between plaintiff and defendant, and granting plalntitf a divorce from defendant a vinculo; allowing her 'to take her maiden name of Olive Gilbert, and for such other and further relief as is Just and equitable; above relief prayed on the grounds that on or about the 1st dayof August. Diss, defendant willfully and without cause deserted and abandoned this plaintiff, and ever since has and still doe so denert and abandon said plaintiff, and live separate and apart from her against her will snd without her consent : aud that since March 1st, iswt. defendant has failed and neglected to provide for plaintiff th common necessaries of life, although of sufficient ability so to do. And you are hereby notified that if you fail to appear and anawer the eald complaint as shove required, the said plaintiff will apply t the court for the relief demanded therein. Witness the Hon.
