Show SUMMONS, In the district eburtof the third Judicial district dis-trict of Utah territory, County of Salt Lake. Olive Avery, Plaintiff, vs. Sylvester Avery, Defendant. The people of the Territory of Utah send greeting to Sylvester Avery, defendant. -70U ARE HEREBY REQUIRED TO AP-L AP-L pear In an action brought against you by the above plalmlff In the district court of the third judicial district of the territory of Utah, and to answer the complaint filed therein there-in within ten days (exclusive of the day of service) ser-vice) after the servlve on you of this summons If served within this county ; or. if Berved out of this county, but in this district, within twenty days; otherwise within forty days or judgment by default will be taken against you, recording to the prayer of said complaint. The said action Is brought to have a decree of this court dissolving the bonds of matrimony matri-mony between plaintiff and defendant, and granting plalntltf a divorce from defendant a vinculo; allowing her to take her maiden name of Olive Gilbert, and for such other and further relief as Is just and equitable; above relief prayed on the grounds that on or ahout the 1st day of August, IRKS, defendaut willfully and without cause deserted and abandoned this Slalntlff, and ever since has and still does so esert and abandon said plaintiff, and live separate and apart from her against her will and without her consent: and that since March 1st, 1HM. defendant has failed and neglected to provide for plaintiff the common necessaries of life, although of sufficient ability so to do.
